  • Threatened with Mackenzie Hall

    The long and short of it is that I (stupidly - I know)took out a pay day loan with Quick Quid, my circumstances changed and I was unable to make a full repayment when I should have. I tried to get them to agree to £25 a month, they wouldn't agree, nor would they allow me their bank account details so that I could at least start repayments whilst we were negotiating repayments. Last week they emailed me,;they were no longer dealing with me and the account has been sent to Mackenzie Hall. I have read the various threads and I have to admit, I'm in a cold sweat. I do not know what to do next. Any advice gratefully received.

    If the account has gone to Muck Hall then rest assured that Quick Quid have washed their hands of it & have no serious intention of wanting any money back.
    Muck Hall are the laughing stock of the DCA industry and have no legal powers to any money off you whatsoever.
    Just remember the golden rule - never speak to them on the phone and refuse to answer security questions if they phone you.
    You offered £25 repayment, they refused - tough on them now, they wont get anything thanks to their greed.

      Do not worry about it, i can guarantee Quick Quid will have created a new loan agreement for the months the the original loan was extended to via extension as a result of non payment - Plus they will have altered the agreement you signed for the original loan, to cover the full period including the period covered by the new loan agreement for the extra months forming the extension therefore making the original agreement a non originally copy of the executed agreement, and also making the new agreement covering the months of the extension fruaduelent as you yourself would not have signed it but they simply will have signed it for you by typing your name onto it.

      The reason they sell to Muckie hall is because like many debts Muckie hall handle, it is unenforceable.

      Though you should Check your online Quick Quid Account and download/print out copies of the agreements - then CCA request Mucky hall - as i gaurantee, they quick quid maywell alter the agreement back to the original state when executed, but as you dowloaded/printed copies you will have evidence of their unlawful actions lol.

      Also, if Quick Quid didn't send you a default notice, then as they have sold the account without sending a Default notice (though if they did its likely invalid anyway) then they will have upon selling the account, committed unlawful rescission of contract, making the loan unenforceable in court on that alone as well. Though you will need to make sure the account has been sold and that muckie hall now own the debt and are not simply acting on behalf of quickquid prior to metioning anything about the DN.

          if they send you as many letters as they did to me you will save a fortune in toilet papper

            Yeah but just so you all know, there letters contain that much crap already that they are prone to blocking up the toilet lol

              sorry if im posting this in the wrong place,but here goes is this normal procedure for Mucky hall
              what the question im asking is is sent them a prove it letter on tuesday the week which as you know states that i want have no contact with them until they can send me the proof that owe the sum of money to Mucky hall yet why do the keep phoning me once a day still even tho i dont answer the phone .

                They're ringing me all the time now. Even at work, which is driving me crackers because I'm in an open-plan office. I wouldn't mind so much but they say they've sent me a letter which I have most definitely not received. And the woman who rang was was horrible - methinks they don't get customer-service training!!

                  They bother you by telephone because that is the way those momzers operate.

                  Send them a letter stating that, as they have not heeded your previous letter, you are now making a formal notice under Section 10 of the Data Protection Act 1998 - link - requiring them to cease all data processing involving your telephone number(s) and to remove the aforesaid number(s) from their records.

                  When they do neither comply nor tell you why they will not comply, you can either make a complaint to the Office of the Information Commissioner or seek an order from a County Court compelling compliance.

                    Are they calling you on a mobile number - in which case, you should either get their number(a) blocked or your number changed - or on your employer's number?

                    Well, it's probably not what you might call "customer service training", where one is taught to listen to what the other person is saying and to respond to their needs.

                    Their version is more akin to assertiveness training, whereby they are taught to bully, browbeat, blag and, if necessary, just tell lies to get the other person to capitulate; as an added incentive, they are probably on a fairly low wage which is boosted by the number of "bonus points" they can score per week.

                        Then they have (a) contravened the Data Protection Act 1998 and (b) may have contravened section 40 of the Administration of Justice Act 1970 - link - which states:
                        (1) A person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under a contract, he—
                        (a) harasses the other with demands for payment which, in respect of their frequency or the manner or occasion of making any such demand, or of any threat or publicity by which any demand is accompanied, are calculated to subject him or members of his family or household to alarm, distress or humiliation;
                        Unfortunately, the penalty for this offence is trifling and insignificant, but it may also be contrary to The Consumer Protection from Unfair Trading Regulations 2008; section 3 - link - forbids "unfair commercial practices" and states that practices listed in Schedule 1 of the Act are unfair, whilst section 8 - link - establishes that the offence may be committed knowingly or recklessly. Schedule 1 - link includes, at paragraph 26:
                        Making persistent and unwanted solicitations by telephone, fax, e-mail or other remote media except in circumstances and to the extent justified to enforce a contractual obligation.
                        Section 13 - link - sets out the much more realistic penalties for offences contrary to those regulations.

                          hi just a update from before i sent Mucky Hall a prove it letter after they sent me a form asking me what i could or could not afford to pay back what which included what bills are was paying and expenses going out etc anyway i wasnt prepaired to send back this form under no circumstances with no proof that i owed this loan in the first place so i sent them a prove it letter some what 2 weeks ago i still havent heard from them since i reckon its stat barred i thought i would keep you updated thankyou alll for your help i willyou updated .
