    Minded to refuse/revoke a licence

    Where there are substantiated doubts about a trader's fitness, the OFT issues a 'Minded to Refuse' or 'Minded to Revoke' Notice (MTR). This is a formal notice advising the applicant or licensee that the OFT is minded to refuse to grant them a licence or is minded to revoke their existing licence and inviting them to make representations to an independent OFT adjudicator who will make a decision on the case (see below). The trader retains their licence until the adjudication process and any subsequent appeal is concluded.

          Brilliant news.

          They have been harassing the wife for a debt she has no knowledge of, that is statute barred as its (now) over 6 years old and which they only have a vague address for (they gave a range of 48 different house numbers for the 'debt'). In a completely different town to us. The only similarities were my wifes maiden name basicly. They even defaulted her credit file for the two months they were able to before it became barred.

          After complaining and doing the 'prove it' these monkeys put in writing that they were pursuing a debt with nothing more than an amount, a vague address and a name - no CCA, no other proof. But they still wanted their money or court action was imminent, and they noted her "new address" as being where we live now (shes lived there for 7 years).

          I really hope their license gets revoked. Ill be writing to the OFT based on this. Anyone know where is the best place to write to at the OFT to make sure this kind of information lands on the desks of the people making the review of their license?

            I would think this will take a while but at last a posibble revocation of licence and the fact it is even threatened will make the rest sit up. I will never know why the OFT didn't do this along time ago - they have plenty evidence they could have acted on and didn't. They are not fit for purpose and have completely failed the consumer.

                I doubt it will; only actual revocation of a licence might do that.

                Merely saying that the OFT is "minded to revoke" a licence means next to nothing, as there are at least two possible appeal stages before the licence could be revoked.

                One might as well say that pigs and/or elephants are minded to fly but, until they start to grow wings, it would hardly be wise to stock up on sou'westers and oilskins.

                Apart from them possibly being somewhat indolent or rather disheartened after other cases were lost on one or another stage of appeal? Well, the OFT does seem to make money by selling Consumer Credit Licences; it might not assist their marketing strategy if those licences proved to be easy to revoke.

                I entirely agree, which is why I call them the Office of Faffing and Twaddling.

                Their failure to protect the public may be part of the reason that they are to be abolished although, with some of their role being handed to the Fundamentally Supine Authority. one can hardly hope for an improvement in public protection.

                Perhaps the OFT, as a final act, will actually revoke all those licences (including the one currently held by Barclays Recovery Services Limited) and let the FSA sort out any subsequent mess by restoring those licences and thereby losing any remaining credibility?

                    Debt collection agency Roxburghe is thought to be appealing against a warning from the Office of Fair Trading that it is minded to revoke the company’s consumer credit licence.

                    The regulator (OFT) issued related "minded to revoke" (MTR) notices to Roxburghe, HFO Services Ltd and HFO Capital Ltd, all of which are trading names of HFO Services, on 20 May.

                    The debt collection agency would be unable to trade if its licence was revoked.

                    The OFT said the adjudicator is likely to make his decision in the next three to nine months. It added that the company has the right to make representations to the independent adjudicator before a decision is made.

                    The OFT said there is also a "minded to exclude" notice against Alasdair Turnbull from coverage of the group licence held by the Law Society of England and Wales.

                    Turnbull, a solicitor for the firm Turnbull Rutherford, is listed on the Consumer Credit Register as ‘an individual running’ Roxburghe alongside managing director Gary Osner.

                    He is also listed by the OFT as an individual running HFO Services and HFO Capital. Five other people are named on the HFO Capital licence with him.

                    However, information filed at Companies House suggests that Turnbull resigned as a director of HFO Services on 12 May 2009 and was succeeded by Badri Nathan.

                    The last set of accounts filed by HFO Services at Companies House lists solicitor firm Turnbull Rutherford as the secretary of the company.

                    Roxburghe compliance manager Kelly Boother told Credit Today it is not yet clear what the decision will be. She said: "We are involved in a process at the moment but we’re not able to make any further comment on the advice of our lawyers. We really don’t have any outcomes at the moment."

                            Their Indian operations were called Validor Capital. The website validorcapital.com has gone offline recently. Looks like they want to lay low untill their legal issues are sorted. On paper they want to show Turnbull Rutherford Ltd has nothing to do with Concilian Group, So Mr. Turnbull moved Offices and tried to rename the company to Quarter Deck Law.
