  • Please help

    Hi there,
    Please can anyone help me and advise how to remove a default off my credit report from Activ Kapital.

    Here is the info off experian:


    Default Balance: £1,102
    Current Balance: Satisfied
    Defaulted On: 13/10/2008


    The balance on the account is zero and has been for 2 years.


    I do not recall receiving a default notice.
    Any advice would be great and I would like to know if there are any letter templates to start enquiring to Activ Kapital about having this default removed.

    Defaults are extremely difficult to get removed. what was the background to the default - had you had an unpaid debt for a long time that wrecked your credit file, then had the default applied near the end of the 6 years or what?

    As far as I know there are no template lettes, but there are arguments you can use which may help, but as I said it is a very difficult issue and I wouldn't get your hopes up.

      Thanks for replying,
      I missed a few payments as I had to find funds to pay for my dads funeral.
      An excuse I know, but it was the last thing on my mind at the time.
      The default was applied to which I cannot recall being notified of it.
      I also paid the balance off in fullwhich amounted to around £1000

            If the default is correct and they had grounds for applying it, then it will stay on your credit file for 6 years, although it will show as satisfied.

              Agreed Wendy,

              There are very long threads all over the place about defaults and CRAs. It is a very difficult subject to deal with. Technically diddydicky is probably one of the best to follow on this.

                hi,

                i would say that your best course of action is to write a nice letter to the creditor and explain the circumstances that led to your missed payments and the fact that you did not receive a DN but did settle the account as soon as possible and ask them if they would remove the entry,

                failing which you could write to the CRA and have a short note applied to the entry with an explanantion

                if you do so- keep it VERY short and sweet

                for instance

                "due to bereavement=payments missed- then settled in full!"

                      I've tried a fair few of these appeals to the good sense of past creditors, all to no avail. Most recent was BMW Finance, with whom I settled a debt in Jan 2008. 9 late payment markers (!) for term of the loan but paid in full at the end of the day and found the late payment markers (some of which go back to 2004) have been locked in time on my cred files for 6 years from the date of settlement. So, by doing the right thing (paying them and meeting my obligations) I will have late payment markers kept on my cred files for 10 years.

                      I wrote a nice, bespoke letter to BMW Finance asking them politely to consider removing the account as I had (1) settled it in full (2) settled it over 3 years ago and it couldn't possibly affect them now.

                      response was a refusal, point blank to shift it. Got a call from a smarmy customer relations manager saying they were "obligated" to keep the data there for the full 6.
