    Hi All

    One of my creditors (Capital One) has now passed one of my accounts to a DCA called Credit Solutions Limited.

    This account has been under dispute since my DMP began and has been passed around various DCA's but this lot seem particularly tenacious.

    They have made various threats (legal action, doorstep visits etc), however they have ignored my correspondance asking for proof of the debt.

    This week I have received a letter from Power 2 Contact who are threatening to visit my home if I do not contact CSL by phone.

    CSL's response to the 'doorstep visit template' letter was as follows:

    "Credit Solutions Limited offers a door step collection service whereby field agents visit a property to discuss repayment of an outstanding amount. This is simply another option available to our customers to assist them in repaying their debts.

    In relation to field visits in subsection 2.12 of OFT guidelines doorstep visits must give adequate notice of the time and date of visit. The Armstrong v Sheppard (1959) case you quoted is dependant on each individual circumstance and only such order to refuse access can come from a Court and not from the individual"

    Now if P2C do bother turn up they will be told to sling their hook in very short order but I'm wondering if a CCA request or SAR request is now the order of the day?

    I would also like some guidance on the response to the whole trespass thing, what I can quote etc?

    I am simply going to say for the moment, that they will be wasting their time as I will not discuss anything with their field representative and everything should be kept in writing.

    IF they do arrive, simply tell them to burger orf, as is your right.
    After all since when do we discuss financial matters with anyone that simply knocks at the door.

    Either that or ask him where your pizza is

    but of course you KNOW this is yet another ploy for them to get you to contact them on the phone..

      Oh yes, I've not fallen for that one!! I'll see what they do when they get my CCA and SAR request next week. This will only be the second creditor I have done this to, but they have been such complete @rses they deserve it!

          How many times have they physically made contact with you now? as you (and them) are probably aware 2 times constitutes a harrasment offence, if youve told them in writing that the contact is to stop. Ive had a major kickoff last 6 weeks with the "outfit" in Cardiff. I got our solicitor to write to them and tell them ANY more (doorstep) visits and I am to call the police, get an incident number, then the civil recovery claim can begin as the evidence is on the table (have cctv shots from a previous visit). The cheeky *******s replied to our solicitors letter to state they were exercising their right under OFT collection guidelines. I wrote to them stating to them that if thats the case then they consider themselves above the law. written response from them 3 days later was that my letter had been noted and no further contact was to be made, so sooner or later a decision has to be made by these idiots that they're stepping over the line. I think its disgusting and out of order that they have to rely on intimidation which is what a so called doorstep visit is all about.

            Hi Brian,

            These people are a joke along with several others. If you have sols (as we do as well) ANY direct contact with you is an infringement of clause 2.8 paras c & d of the OFT guidelines which deal with the "bypassing" of "Appointed Representatives". Keep good records as this can be used later if they ever dare to go before a court of law. We have a list of 16 plus three solicitors practices who have tried it on. The counter claim against the OC is going to be large indeed and the SRA will a nice field day.

              Welcome to the merry go round of CAP 1 I bet you get a reconstituted agreement from CAP 1
              Credit Solutions and Power to Contact are the same company they threatened all of the above not heard or seen anyone no one came knocking and that was last September
              Oh and if they haven't already contacted you Scotcal will be the next and guess what no will tell you they are passing you on naughty naughty CAP 1 and if try to carry on paying no one will take your money either

              Forgot to add I got the same letter having sent off the doorstep collection and you may get a yellow card saying we will call with no specific time or date filled in Muppets love that word Curly

                When we went through this lot it would seem that they are all interwoven, P2C, CSL, and Scotcall seemingly all underwritten by some pretty powerful money like from the big banks.

                However once anything legal is threatened and thrown back at them by you they all ran away in our case not wishing to take something on in which they were out of their depth.

                Perhaps more correctly slithered back under the slimy stone to find another victim who was easier to prey on.

                  You have asked for proof of the debt, they haven't given you any so if you have told them the account is dispute they cannot pursue it any further until the dispute is resolved. Send any letters after that to the OFT telling them the account is in dispute and you are being pursued for it in breach of OFT guidelines, with a copy of your letter to the numpty DCA. The doorstep visits, if carried out, are easy - they have 30 seconds to get off your doorstep or you are calling the police for trespass and threatening you with menaces. No one ever came to my door but I vowed if they ever did I would run into the middle of the street and shout "Help" Police!" Good job they didn't come because they were going to get more than they bargained for.

                  All of their threats are hot air. I have been reading posts all over the web about DCAs and they are becoming increasingly desperate for money and are quite willing to break guidelines at will. In response you will be paying them zilch for being so stupid - and it is costing them money. As for Capital One, they wouldn't know what an agreement was if they saw one.

                    I have made a formal complaint to OFT about CSL, they have been phoning me every day (some times twice a day) since Jan this year , I have a truecall machine so all calls, dates and times are recorded. power 2 contact also sent me a card said they would call over the xmas holidays, I'm still waiting

                      Hi All

                      Thanks for all the responses and support, frustratingly I was paying Cap1 and then they assigned my account to Freds International, who quickly farmed it off to CSL when they realised I was more trouble than I was worth.

                      Its always good to know your opponents 'game plan' so thanks for all your feedback so far.

                      A CCA request has gone off today. I genuinely cannot remember signing a credit agreement for this debt so will be interesting to see what they come back with!

                        I seem to recall that one may use reasonable force to eject a trespasser from one's property.

                        If that is true, would the use of a water pistol or hose-pipe aimed through the letterbox at a trespasser be considered to be reasonable or excessive force?

                          It would be considered an accident. I always water the plants in my front garden by a hosepipe through the letterbox. It would be just unfortunate that they were stood there at the time............



                          Not sure I could use this though for water bombs from the upstairs window though
