    Round and Round and Round she goes!!!!!!

    Hi All

    Well I sent me letter off to Newmans last week basically telling them to bugger off.

    So whats happened? I now have received a letter from RMA (Risk Management Alternatives) stating that they are now acting on behalf of AMEX!!

    My account is being thrown around like a proverbial hot potato? Why do these DCA's not want to deal with me?

    The good news is that they recognise my DMP but with a review after 6 months.

    So that seems to be settled for 6 months, after which I'm sure that the fun and games will start again!

    So........

    Hello RMA

    I look forward to who my account is going to get thrown to next!!

      This is the very thing that the judge in the recent Mercantile court judgement in the Link case frowned upon, was that the DCA's kept on changing. and this tantamounts to harrassment and my o/h has had the very same happen to him, a few weeks with one DCA, then goal posts changing again to new DCA. http://www.legalbeagles.info/forums/...530#post200530


      My o/h had actually made a proposal to clear the debt in full direct with Amex by way of letter directly to them a couple of months ago, they have signed now for two letters from him and instead of responding to him they have passed it to yet another debt collector now Moorcroft that Amex has told them that there has been no contact or proposals.

      My o/h has the evidences to substatiate this, so watch this space.

        Thanks for that link, I did read it a few days ago and its great to see a judge acknowledging the levels of harrassment that DCA's and creditors subject people to.

        Sorry to hear your O/H is experiencing similar issues to me, though unfortunately it really doesn't surprise me. If you're keeping all your documentation thats the best thing you can do.

        I think any DCA or AMEX would be foolish to take me to court now on the basis of the communication I have from them, plus their own complaints department upheld my complaint on their handling of my financial situation.

        I just find it funny how RMA are already trying to dress things up so this is a 'temporary offer'.

        Well it'll be as temporary as long as my financial situation stays the same!

        I'd get a complaint into AMEX and show them proof of delivery/receipt and the letters from Moorcroft stating that no proposals have been received and that you are trying hard to clear the debt but their actions are actually preventing this from happening.

        Hopefully if you can then get your complaint upheld it gives you more leverage over the DCA's

He has written to Amex and again by recorded delivery sending them a copy of previous correspondence, pointing out that all has been signed for and the copy of the letter from Moorcroft - a very threatening letter indeed. He has quoted them the harrassment bits as well as well as the recent judgement, so if they want to play games, we are one step ahead. They have a perfectly good offer on the table so why do they waste everyones time and if they took it to court, I am sure a wasted time order will be sort as well. He has also sent Moorcroft a copy of the letter which he sent to Amex, so if they want to play games well see what the Judge thinks.

          Hopefully if you can then get your complaint upheld it gives you more leverage over the DCA's Amex seem like that they do not respond or like responding.... well that is there problem.

          These letter that are being sent out are just a total nonsense.

            RMA, possibly the biggest pile of steaming excrement in the DCA world.
            They have ZERO grasp of CCA or any consumer rights.

            They like to hound people with numerous calls a day.
            I ended up changing my phone number because of their actions.
            So get in HARD and FAST.
            Kick em in the danglers !!!

              I certainly will not be sending them a signed document stating that I agree to their 'criteria' as it states that this is a 'short term agreement'.

              I also wonder what they would want my signature for? Hmmmmmmm.

              Or maybe I'm just being too paraniod

              Well they can't telephone me as they don't have my number due to changing it for the same reasons (I was getting 6-8 calls an hour from my creditors collectively!) so I look forward to what garbage they are prepared to put in writing!

                Boring I know but playing letter ping pong with Cap 1 again myself
                So have fun if you can for 6 months or will you miss their love letters

                  LOL, oh how I will miss those letters. Still I am getting others that are keeping me entertained!

                  This was the biggest headache really behind Santander (who are still not playing ball), but slowly getting there!
