    If you have been repaying since 2001 then its not time barred as the clock is reset each and every time you make a repayment. So the 6 year clock would start from the date you last paid in 2011, which means it won't be time barred till 2017.

      Agreed, doesn't sound to be stat. barred, yet.

      Now, one wonders as to whether Link would be able to come with a valid MBNA credit agreement, together with the inception terms and terms as varied?

      One presumes that this would be an cc issue 2001?

      Sounds like, Link are already on the back foot!

        Can my UK debts be pursued in Australia?

        The straightforward answer to this is yes-they can be pursued in Australia. If you live in Australia and have debts in England there is nothing to stop an English debt collector passing his file to an Australian debt collector if they have located you.
        We have experienced many cases where a person has been located in Australia and has an Australian debt collection company pursuing them for debts owed in England.
        Please note, the original Creditor/DCA would have to provide a valid credit agreement with the prescribed terms as per the CCA 1974! [Emphasis Added]

          So youre saying that Link Financial would have to provide the original credit agreement as drawn up by MBNA and signed by myself?...And why is the emphasis on 1974?...Sorry, Im so new to all this!.....Also, why would an English DCA pass on a debt to an Aussie DCA?...I can only pay ONE DCA!...I am assuming that they would ask an Aussie DCA to act on thier behalf and then give them a cut of whatever they get out of me!..Surely i would be within my rights to say to the Aussie dCA "Sorry mate..I dont owe YOU a thing"!

            ..about 2 months ago my 19 year old daughter called me from the UK to say that someone from Link Financial had called HER on her MOBILE phone and asked of my whereabouts. They obviously had no idea i was in Australia..but told my daughter that "they needed to speak to me as they had an important parcel for me"!...My daughter didnt smell the rat unfortunately, and oblivious to the outcome gave them my details. How the hell these people obtained my daughters mobile number is a complete mystery and Im pretty sure they have acted underhand by contacting her and obtaining my details under false pretences...Needless to say, they have now been ringing my Australian mobile number..(I dont have a landline)..at all hours of the night and leaving voicemail messages asking me to call them...which of course i have ignored!
            This is normal (bad) practice for Link Financial!

            Suggest that both you and your daughter change your mobile phone sim cards.
