sudden chase for old debt- help

new to the forum so sorry if this has been addressed in full befor e- but your help is needed

i've rec'd a letter from DLC saying they've bought an old debt from 2007 from a company called Freeway

Freeway was my HP company for a new car - this was terminated after 18 mths with no further communication until this letter claiming i owe just shy of £3500

My understanding is that i had paid all fees and debts when the car was given back to Freeway

I've had not a single communication until yesterday when this chase letter arrived.

i've spoken to DLC and it feels wrong

any advice welcome

First NEVER call a DCA, no matter what.
They will say anything to secure a payment.

If they call you simply state that you require EVERYTHING to be in writing for the avoidance of doubt.

For now wait until they write again then send them a Prove It letter, post #4 on the first link in my siggie.

Definitely follow Curlyben's advice first. He is never wrong!

In the meantime to give you something to do, see if you can find the paperwork relating to the handover of the car. I assume it was still under HP and you returned it. They normally don't demand fees at this stage, they auction the car off, then send you a final balance owing with a breakdown of all fees.

If you could find this it would be useful - if not, ignore it for the moment, if they contact you again send the prove it letter, then if they get in touch again come back and post for help. Just going through exactly this myself - been dragging on for over two years now!

thanks - had two letters today, one with a copy of a fax which says the sale of the debt, but nothing on the paperwork which indicates its my debt........the other appears to be confirmation that the debt recovery company are confirmed as a memeber of data protection act

not sure if i need do anything ??

been 5 months now since last two letters, and rec'd a brief letter which inlcuded an statement of payments to the original lender, which ends in 2007. then in 2010 add a £300 fee as costs.

letter asks for payment with days or "taking further action", but as previously mentioned i dont believe i have this debt and certainly not to the company chasing me.

any advice or letter i should send to this in response

yes - but its not that convincing....seems like some gaps...no sign of my signature etc
