  • Unenforceable Credit Agreements

    I am rather new to all this - although am very glad to see that I am not alone!!!!!
    I have only just heard about the pre April 2007 and unenforceable credit agreement situation. Is this a viable route to 'write off' debts which I frankly now have no way of paying off or is it just another loophole.??

    No unfortunatly debts can't be written off but if you send a CCA 1974 request letter to the creditor and the agreement has not been properly executed then it becomes unenforceable and you can legally stop paying them, for a guide of all the ins and outs involved click on the link below. curlyben really has done a good job of explaining the whole procedure, he's made it easy to understand aswell as providing template letters to send.

    Should you send a cca request only print your name never sign it, enclose a £1.00 postal order, send it by recorded delivery and then they should reply within 12+2 days. When you receive a reply start a thread and scan up their response with your personal details blacked out and someone with more knowledge than me will come along and advise you further
