    MBNA it appears have sold to Altiv Kapital a debt, which MBNA have never informed Mr T of. He has been discarding letters up to now following Curly's advice.

    Also, their may well be charges still to come back on this account which may well be substantial.


    Akitiv have now written giving a final 30 days before they will proceed to court?

    My question is:

    1 Wait till the court papers come if they do? and then ask them for proof of the debt and the assignment?

    2. Send them one of Curly's lovely letters now and ask them for proof of the assignment?

    Please let me know your thoughts?

    Hi Tuttsi,

    AK have contacted me re an alleged debt (which btw is from so long ago, the agreement was probably written in latin!)

    They informed me that they were acting for the company who has purchased the account. (Er, no letter of assignment from the original lender - & who is this mysterious new owner??)

    After one or two 'threats', they offered me a 'once in a lifetime' special discount of 50% if I 'settled'.

    I'm pretty sure that there is no money owing (an old clothes store card, used only for purchasing small items), & it would be statute barred anyway.

    However, I too have read the copious advice given by Curlyben, & in the process I have made a considerable saving on toilet paper purchase.
