    Hi

    I currently asked BLS/Lloyds for a signed copy of my credit agreement. They consequently sent a copy. I have scaned it in. Attached to my copy was bank copy of conditions of use. I was wondering if this was enforcable. To me it is an applicaiton form.
    This was the first credit card i signed up for. I was at the college on a training for work scheme that mean't i had an extra £10 a week put on to my benefits. I was called into the branch by my account manager and she pushed me into having this credit card. I had never gone overdrawn in my account and i was managing everything fine. I didn't need a credit card. Now i never had a copy of anything i signed at the time and i have never had anything.
    When i got my agreement i noticed that the address of the employer was wrong as she had put my work experience placement down and she had also put in the wrong address for the placement. She had also put me down as employed though i wasn't.
    I honestly wouldn't have put down the incorrect address, she didn't ask me for any proof of income which would have to have come from my benfit book at the time.
    I think some of this information was filled in after i had signed. I know that i was to blame for my debt. But i was managing my money fine until she pushed this card down my throat. And she really did push, until i said yes. So some of the information on this form is incorrect and was never varified by her or anyone else.

    What does anyone else think and could someone help me as they are now pushing me for money as they believe they are now in their rights to collect on the debt.

        Hi. Have reported your post so it gets attention.

        In the meantime, are there charges on the account? ie late payment charges, overlimit charges etc that you may be able to recliam? This would reduce the balance owing. Have you tried to come to any arrangement about reduced payment plan at all?

          How did you come by the agreement? Was it by CCA request or SAR??

          If you sent a CCA request then i would do a SAR, as with a lot of credit card companies this is the only way to get the credit agreement.

            It looks valid to me. I know it says application at top but its also got all the prescribed terms in (so far as i can read it) and seems to be executed.

            However this does seem to have issues in the way it was 'sold' to you and considering your income at the time might be construed as irresponsible - although that has tohave an extremely strong case behind it which I don't think you have, but you can use that to get sensible repayment arrangements on the debt.

            how much is the debt on the card, and how much can you reasonable afford to repay each month ?

              Hi everyone thank you for your help

              In response to maruvian, i did request a sar but they just kept telling me that it was in my local bank and my local bank had no knowledge. So i then sent them a cca request and a cancelled the dsar request and they sent my money back. So this is what was sent but they were stapled together.

              To answer amethyst my debt is for £3416. 72 And i have been paying token payments of £1 since 2001. I can't afford anything else i am a full time mum and i suffer from clinical depresion and anxiety. So the reason i asked them for information was because they were hounding and harressing me for more money and i simply haven't got any more to give i have various other creditors to pay as well as everything else. I am finding it really hard. And now it is all seriously stressing me out. And i am having enough to put it midly.

              Anyway i am still smiling

                It seems to me you are being given the runaround here. I would SAR the credit card company and BLS. They are legally obliged to respond to SAR within 30 days with all information they hold on you. It will cost you £10 for each one so if you can't do both at once then I persoanlly would do Lloyds first. The info will not be at your local bank it should come from the credit card company, send the SAR to the address on your statements. Then you will be able to look at the statements they provide and see if there are any charges accumulated on the account which yoyu can reclaim in order to reduce the balance owing. It may be that BLShave also added on charges whgich are not legitimate too, but you will only know this when you get SAR info from BLS as well.
