Hi Everyone, it's my first post here, and I'm not sure if it is the right place,
I have an on going court case with Link financial for a loan that I had with GE Money a year ago, they have sold the debt and link has took me to court. I have defended the claim, but the judge made an order as follows:
1- the defence is struck out as disclosing no basis for defending the claim.
2- permission to the claimant to enter judgement.
I have filed in a N244 form and asked for the court order to be struck out, as the defendant was unable to file an amended defence until the claimant provide the documents requested.
The application hearing is taking place on 13 Nov, so I have send a request for documents under CPR 31.14 to the claimant last week, and they have ignored most of the things I have asked for again, they only sent a copy of the agreement and a copy of the notice of assignment, although I have asked for the assignment itself and the termination notice and the default notice.
This is the back ground, to the case, and I'd like some help please to what my next move should be, either to avoid going to the hearing, or put them on strict proof to the fact that they do have a right to sue me.
