  • Unenforcible Credit Agreements & Claims Companies

    Pleases can anyone help me to decide wether to use a Claims Company to write off a £13k debt with Mbna, based on a pre-2007 unenforcable credit agreement? The claims company are chaseing me for the £500 fee to get started, they claim (by email) that they can have my debt written off. I cannot really afford to pay these fees, but neither can I afford to pay the debt at the current rate they are charging. To date I have missed no payments, but due to circumstances beyond my control, this will no longer be the case. Due to Disability, my family recieve benefits and a small part time income , we are in serious debt, have no equity in our Property and cannot afford to be conned.

    I have tried really hard to check this Company out, they appear to be ok other than their fees! I have read everything I could find on your site (thanks for that) and in other places online but still feel unsure.

    I have never been on a forum in my life so I don't know how this will work, but I would be extreemly grateful if anyone might be able suggest if I proceed or not, based on actual experience?

    Just because the agreement is pre April 2007 DOES NOT mean it is automatically unenforceable !!!

    Sure use a claims company, pay a large upfront fee and percentage of the outstanding balance, for the card company to still default you and hound you into court.
    OR, Read and do it yourself.

      Just wanted to say thank you Curlyben for your reply (but wasn't sure where to post it) am finding some of the jargon difficult to follow as a forum virgin, am still trying to find my way around. Have decided NOT to use Claims Company will have a go at DIY, now I have found all your helpful information. Thanks again. Pebble.

        feel free to ask anything that you might find confusing.
        After all we have all been forced into this type of action due to unreasonable behaviour by creditors.
        All we are trying to do is assert our rights under statute law.

        THREE (well nearly four now) years ago I was in the same boat, but have since been on an extremely steep learning curve with regards consumer credit law.
        I must say it's a fascinating subject, especially for a techie geek like me

          Are you aware of anybody who has actually had their debt written off due to an unenforcable credit agreement, I have heard rummors but have not found anything more solid? I have had a free assessment and been told my agreement has several unenforcable points that they (Kerobo) can use to get it written off, is this really something I could do myself? I am only finding conflicting opinions about this, but perhaps Iam not looking in the right places!

            Kerobo certainly come under my heading of BAD CMC's.
            They charge a huge upfront fee as well as a % of the total balance on completion.
            As well as that their adverts make alot of extremely missleading claims about what is possible.

            Now where did I put my barge pole.
