if phoenix have bought the debt... will it show up on a land registry search on my property? Im just thinking that I dont mind spending the £4 (or whatever it is) to see.... I couldn't wait & have had a look at my land registry info... the charge is still registered to hfc.

In a previous letter Marlins state that hfc terminated my account on 31st May 2007......BUT the last time that hfc updated my credit file was on 3rd July 2009.... (still showing as a default with a o/s balance of £8875).....

Apparently..... hfc sold the debt to hsbc & hsbc sold the debt to Carvel (also known as Marlins)... in July 2008.... :-/ .....

I rang (he's not a dmc so i thought it would be ok) the bank charges complaint guy (to keep my complaint open) who incidently told me that my sar request was complete & I should be receiving it in a couple of days...... I asked him if the charges I will be complaining about would be taken off my outstanding amount & he went on to say that they sold the debt in july 08...then I was told it was sold to hsbc... hsbc claim to have sold it in may 08 (2 months before hfc sold it to them lol) to carvela.....
As far as theyre all concerned they dont own the debt...

Im just keeping the situation updated in case anybody else is reading this & having a similar experience

Also - as a judgmented debt - the change of ownership of the debt should have gone through the court.

Yes, am awaiting on court documents....

The charge at land registry as at Sunday was still with hfc.

I only asked if the refund of charges would go back onto my account in the hope that he would say yes & therefore establish I still owe them!

Just a thought........ should I reply to mortimer clarkes assignment letter...just acknowledge it & mention that I am waiting on my sar info... or just leave them to do as they please?...

I have just rang up Leicester county court to chase up the court paperwork...

* They said that they'd wrote to me on 19/8/2009 requesting a copy fee of £5 per sheet...I told them that I haven't received it...which I havent... A Mr Murphy has said that he'll ring me back later...

When Mr Murphy checked the claim details, he said 'Its yourself & Phoenix from 2007....' I said no its myself & hfc... he said it was down as phoenix on his system..... I am currently feeling a bit deflated about this.

All comments, advice etc is welcome
