At this moment in time, Cabot have suspended collection because the oc cannot locate a signed agreement in their archives.... to be honest, I don't think they will find a signed agreement in the name they are sending the letters to..........

Collection has been suspended for a few weeks now.... should I instruct my dmc to put my payment plan with them on hold for the time being because they are still paying them?.....

Once they exceed the prescribed time limits for compliance then you can legally cease any payments.

The cca letter is dated the 22nd June 2009... so I think theyve had long enough now don't you?...

CCA allows 12+2 working days from the date of postage.
So has well and truly run out now

Whilst in default the debt should be completely on hold, no enforcement, interest or charges added. If they come up with it and its enforceable then you pretty much pick up where you left off with affordable payments (but yourself rather than using the DMC as you're slowly ditching them arent you?)

If they don't freeze stuff you can argue, and then you can go for charges/ppi etc if they are applicable.

As for my dmc... I am in a worse position now than i was 2 years ago outstanding balance wise & I have paid them for that priviledge. I think its time I started to run things myself (with the help of you guys if thats ok ;D )... I cant do any worse but could save myself £25 a month!

These "people" make me laugh.
They don't half like to flog dead horses.
I'm currently working on 4 "accounts" with them
3 complete cobblers paperwork and 1 nowt at all

I have received a reply to the default letter that I sent to cabot today.

As per LuggerBugs post, it sounds like theyve got all uppity!

They are basically saying that the debt is still legal, that the cca is delayed because the oc is having to retrieve the info from their archives & that my account has been placed on hold.

Then they write about each of my concerns relating to data processing, Administration of justice act 1970 sec 40 (they say this section has been ammended & cant apply to my case...) & other stuff... I can expand on this part or email the letter to you if you think that I need to respond to this bit?.....
