    How are you?

    Just wanted to give you an update.

    Re: "1. Judgment set aside on condition that the Defendant files and serves a detailed defence by 4pm (today). " , mentioned earlier on Friday.


    I called the court today at 11.15am and the defence has not been received/logged onto their system.

    I was told to call back, again, next week.

        I wouldnt communicate with him tbh, wait for the defence to be filed, just reply formally to his letter on a Without Prejudice basis that you are willing to settle for £400 up front fees plus the £100 back end fee due, plus your costs (court fee).

        Otherwise it will be court, you had a verbal contract with them which was not based on signing an introducers agreements as you were not introducing nor intending to introduce over 25 clients a quarter. He has proven the verbal agreement by paying you for the first three cases referred.

        When you get your allocation questionnaire you can mention any agreement you come to.

        I'd still want evidence that the three claims didnt progress - especially if they were for PPI. Have the clients been refunded their upfront fee (was that the way it worked? I havent checked them out client side)

          Hi Ame,

          You are correct.

          I’ve not seen any evidence of any of the claims at all, especially since my website was withdrawn.


          Everything is held with the Defendant. All of the info provided is on his sayso.

          I don’t know if the clients have been refunded their fees.
          That wasnt mentioned at all, only that they hadn’t progressed.


          I don’t have any court costs as claim was progressed via my wtc remission application.

            okay in that case when you get the AQ you can do a draft order asking that he discloses the evidence to back up his claims that no case has gone to back end.
