Tristar into battle with 1st Credit
Hi all,
Fresh from what I saw as a result regarding my war with Crapquest and just as I was winding down and looking to take on Hillsden, when out the blue I receive a letter dated 02 August from 1st Credit.
The OC is RBS. I have a letter dated 28/02/2007 (as requested by me in Jan 07) stating that the account governed by the above referenced credit card agreement defaulted and was "Charged off" by RBS. What does "Charged Off" mean??
They state that "the outstanding balance is now owned by 1st Crd Ltd following an assignment by RBS on 30th June 2003. Our records show that you are contractually responsible for all payments due" Does that mean they have an original true signed copy of the CCA ??
Now: I have an agreed monthly payment of £**.** per month. I have not missed a payment on this and have not received a request to increase the payments (which I couldn't do anyway). I have not CCA'd as yet.
The letter received dated 02/08 is headed "LEGAL PROCEEDINGS". They state that £****.** remains outstanding and that they indent to take legal proceedings against me Just like that, straight out of the blue Why??
Having read several 1st credit threadsacross the road, I get the impression this could get nasty. So I intend to follow procedure very carefully. First job then is a CCA request and take it from there Should I CCA RBS??
1st Credit if your reading this, as I understand you do, then I hope you have everything legally in place, because if you don't I'll fight you all the way to the House of Lords and beyond Let battle commence
