  • 18 yo £12k Barc CC debt UPDATE PRA now sent docs & say enforceable - is this correct?

    My friend has a £12.7k 18-year old barclay credit card debt now with PRA, who originally said not enforceable but they have now produced docs (short form cancellation, historic t&c and varied t&c) and say it is enforceable. When she queried what PRA sent they said it was a reconstituted agreement and suggested she contact Barclays in case they had any more info so she made sar request and Barclays sent back pile of papers, which show debt exists (along with another smaller cc debt which is not enforceable). And PRA provided statements which show a lot of interest and charges, up until default in 2018.

    I've attached PRA response to query and also PPI doc Barclays provided.

    PRA also say in their response that default will come off CRA reports in July 2024, which doesn't sound right; do you think this is an error? Obv if it comes off credit file, her life gets easier, but she's been paying £1 a month. And they also say PPI was not included, whereas it was but looks like only for six months in 2007. She asked about that in the hope of arguing debt was inflated due to PPI.

    As I said in initial post, she offered them 5% to settle on basis debt was not enforceable but they came back asking for £8.5k, which no way can she afford.

    Any steers as to what tactics could be used to get PRA to reduce amount owed and/or to consider a low offer, would be very welcome. Many thanks.

    That is why the debt is not statute barred and is still enforceable. Your friend has been conned by a debt collector somewhere along the line into paying £1 a month because the debt collector knows this keeps the debt enforceable.

      Thanks, Pallasathena, I agree. But I think the quid a month may have been the lesser of evils, in that if she hadn't offered soemthing PRA could presumably have gone legal and she could have ended up with a ccj or worse.
