    Hi everyone

    I Have had a letter from Moriarty law concerning a debt I had with Sunny payday loans.

    I got into a bit of an hole with payday loans some years ago and managed to get myself out of it by working loads of overtime and paying them off one by one . Now I've had a letter sent to me via some sort of digital text to my phone headed formal notice of our appointment, which States they are Moriarty law working on behalf of United Cash LTD where the originator is Elevate Credit Ltd (Sunny) and I owe them £189.94.

    Now I can't remember taking this debt out with them as it was so long ago , the letter stating I took the loan out on the 19/08/2017 so does this mean the loan is statutory barred ? Can I ask Moriarty law for a break down of the loan ?

    I'm in a better place financially these days so I could pay them but why should I if I can't remember the debt ?

    Any advice on my next steps would be most kindly appreciated

    Statute Barred Letter if you have had no contact for 6 years eng/wales 5 years scotland nop questions as admittance just in case?

      I'm not sure this is statute barred yet, I don't think we have enough information to know. ML may be trying to get in just under the SB wire.

      Although the loan was taken out 6 years and 19 or so days ago that isn't when the 6 years starts running. The 6 years starts (generally speaking) from when the lender's 'cause of action' arose. Typically that is 6 years from date of default.

        1 month after last payment then default issued date after which date to be paid by, playing safe and no acknowledgment after .

          So is OP best advised to ignore it until OP is certain it is SB to avoid any risk of inadvertently acknowledging the debt? Unless OP receives a formal LBA of course.

          I assume ML have the OP's current address so cannot go for a backdoor CCJ.

            some have in the past every case different, M.L. depends if they check CRA files prior.
