  • Offering a partial settlement

    Hello.

    I'm new here and looking for some advice please. I have two large debts with PRA totalling 8k. They are 4k each. I've been in a DMP since 2017.

    Back in April, I requested CCAs as looking to offer a Partial settlement as I inherited a small lump sum when my mum died and thought i would offer PRA a partial settlement which was 40% of the debt.

    1 CCA (debt was with MBNA) was a copy but font was so tiny and couldn't be read with the naked eye. I had to take a picture of it using my phone then zoom in to read it but parts of it were very blurry.

    The other (original debt Barclaycard) didn't send a CCA, just short form cancellation, historic terms and conditions and varied terms and conditions. CCA not mentioned on any enclosed docs and nothing relating to me on the docs. No name or address. They say they enclose a reconstituted copy of my CCA but it's not in there.

    Default for the Barclaycard Debt dropped off my credit file in March this year. The default for the MBNA one falls off Nov this year.

    I offered PRA the partial settlement but they rejected it and counter offered 10% off only.

    Should I write back and tell them there is no more money other than what I have offered? I'm starting to have some health issues and want to get this debt settled.

    I've already paid off 50% of what was owed via a DMP but it will take another 7 years to clear the debt. I just don't want it hanging over me.

    I really appreciate any help and advice on what my options are please.

    do nothing as yet>, CCA must be clear and concisive = They Fail

    PRA await their next move., you have highlighted that you may be a target, so hopefully they do noit.

        You've sent CCA requests, they haven't complied with your requests, no CCA's at all (that's what you are saying).

        What you need to do is send them the following letter, make sure you get Proof of Postage for both letters.

        Once they state 'unenforceable debt', stop paying.

        We can advise on discounted settlement, if that's what you want to do.

        If the agreements were taken out before 2007, they need to provide 'True' copies to enforce the agreements.
