    There is 6 weeks 3 days left until statute barred. I have received some letters but no letter before claim or letter of claim.

    my question is if I receive a letter of claim before the statute barred date, and the amount of days I have to reply goes over the statute barred date. Does this still count?

    so let's say I receive a letter of claim, and the debt is not yet statute barred, and then 10 days go by and now it is statute barred. Do I have to reply?

    statute barred stops at that point of stated in letter of claim.

      Ok. So normally they send a pre action protocol right? Which should give me 28 days to reply?

      if so.. if i send a prove it letter just short of the 28 days, that might delay them sending the letter of claim in time?

        To avoid a claim being statute barred, a claimant must commence court action before the expiry of the limitation period. Writing any kind of letter is not sufficient.

        A claimant who knows that the limitation period is about to expire and who wishes to pursue a claim will commence court action in time and not be sidetracked by any letter or delaying tactic.

          I thought it was my legal right to request this information and that it stops the claimant from pursuing action for a certain amount of days.
