  • Lowell - advice required on default

    Hi there,

I really hope someone can help me. I値l try stating the issues I知 facing regarding Lowell as clearly as possible.

I have lived outside the UK for over 6 years. Upon returning, registering on the electoral roll (opting out of the open register) and looking on my credit report I can see I have a default debt from a credit card, Vanquis, which I opened in 2013 and closed in 2014.

A default for this debt was not placed upon my file until 2 years later, in June 2016, by which time I had been living outside the UK for a year.

According to ClearScore, Lowell made contact with me in March 2018, a claim I know to be untrue as my parents no longer live at the same address from back then and I got a new mobile number when I moved abroad.

Since moving back to the UK and registering on the electoral roll, Lowell have sent a letter to my house every week for this debt (and other telecoms debt which are from over 10 years ago and for 」77 pound and 」95 respectively).

My questions are multiple: is it possible for me to prove Lowell did not speak with me in March 2018 about the Vanquis debt, without contacting Lowell directly? I am aware if you make contact, the debt starts once over.

I would also be curious to know if anyone knows at which point a default debt can be turned into a CCJ?

Also, if debt is so old, (over 7 years old in every instance) why on earth is it still showing on a credit file after all this time?

Thanks so much in advance for reading and for your help!

CCJs on your credit file last for 6 years from the date of judgment. You mentioned that it was placed in June 2016 so if that's date of judgment then it will be removed June 2022. It doesn't prevent them from continuing to enforce the judgment though after 6 years they will need to apply for permission from the court to carry out any enforcement of the judgment.

If you want it removed sooner and have the ability to defend the claim, you would need to make an application to set the default judgment aside on the basis that you were living abroad, possibly on other grounds too but that's a cost of 」275 and in cases like this, there's no guarantee you will get your fee back if successful.

Or you can leave it and see whether Lowell take further action.
If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you
