halifax have agreed to refund payments already made and ccl ppi on loan as agreed in a letter last aug 08 complete with breakdown of payments ect : reducing my debt by approx £ 3.5k
this still has not been done
and last month halifax sold this debt on to cabot for the full amount :
l spoke to the halifax today and they confirm that this account is closed with them so cabot have bought this debt + not just coll on behalf of halifax
during this conversation l was asked if l had signed /returned anything with regard to the loan which l had not

the fos enforced this refund , and in a letter they did say that l may be asked to do a new loan with out the ppi this has never happened
halifax said today that they would see what could be done about this

if they ask me to do a new loan agreement should l ?
also as this laon was in dispute they should not have sold it on
lm still waiting for cabot to confirm and send a copy of the original loan agreement which l understand they should have if they have bought the loan

lf the halifax have "slipped up" to put it politely , l dont want to do anything to make it easy for them to hoodwink me as l do not have the knowledge to challenge anything

If you have already taken this to the FOS and Halifax have failed to do as instructed, then take it back to the FOS for further action.

Don;t worry about Cabot as, like most DCA's, they are full of Bovine Excrement.

Don't enter into any form of conversation with them over this, leave it with the FOS.

Can I please suggest that you don't talk to any of these people on the phone in future, but that you do everything in writing. It will help to have everything in black and white and be a lot less stressful for you than talking on the phone to them.

just thought ld let you know the latest update :

halifax are now buying back the debt from cabot deducting the ppi + payments and then selling it back to them !!
looks like someone at the halifax has made a big whoopsie,
meanwhile im keeping out of it + leaving it to the fos and will ask for everything in writing as you,ve all suggested

Doesn't sound as if Halifux has been playing fair at all. Looking forward to the FOS's findings.

If it DOES end up with Cabot again, I'd be inclined to make life as difficult as possible for them. CB will no doubt concur.

got a letter today from halifux [ like it] lol !! apoligizing for the delay [yeah right] and confirming that the amount has ben reduced to the correct amount blah blah blah ...
havnt rung the fos to tell them do ya think l should ??

as far as l know it will go back to cabgrot , so i expect that they will write to me confirming the new amount owed on the debt then l can start on the do you have the orig signed c/a ect

quite looking forward to a scrappy do with them but will need to pick your brains for that lm not " au fait" with legal stuff but will try anything once ....
even twice if l like it

enjoying watching hbos squirming on tv almost better than corrie

I would make sure you see it all in writing. But assuming for a moment that it has.... what would you like to do here? On a personal level, my preference would be to continue dealing with the OC. However, I understand that they may not exactly be happy to hold on to the account, and may well do as they say and sell it on to Cabot.

I guess the question remains; do you feel that you have now got a satisfactory conclusion to this, and could you afford to repay this debt on the basis that you've got £3.5K knocked off it? In other words, if Halifux offered you a new loan, would that be good for you?

Otherwise, if Cabot end up with it, you could try the usual CCA route to challenge its enforcability, and thus put you in a strong position as regards negotiating a settlement that suits YOU should the agreement prove to be less than kosher.

But do bear in mind that loan agreements in general tend to be rather better constructed than those of, say, credit card agreements.

well the way things are at the moment l,m currently applying for benefits never ever done this before , but l cannot do my job anymore it has totally done my brain in.
so far it looks like the halifux is not asking me to do a new loan agreement. either way lm going to struggle to repay it if im on benefits[ got no option health wise at the mo ] so not much choice really , ive just been so worn down over the last 3 yrs l m finding it hard to cope with anything just now
l will just plod on for now

Remain firm and do not let these maggots push you around or pressurise you they have no power what so ever.

If you do request a copy of the credit agreement, then I would advise you to make this request under the Data Protection Act and ask for an identicle hard copy of it.

In the meantime keep up your repayments to priority bills only, don't worry about the debt collection company, when the time comes make any arrangements with them on your terms only, these DCA'S will or may try to intimidate you or make you believe that they have some sought of authority and can enforce a payment from you, DON'T BELIEVE THEM it's not true.

I hope you are successful in claiming benifits, TELL THE HALIFAX MISTAKES COST! Hold on in there and try to remain calm, these companies can not hurt you, you will survive this.

so now will ring CCCS and let them know, and l suppose l will end up paying a token £ 1 or so to each creditor
at least now l wont worry myself sick that someone will come + take me away

can l just add that lve had so much harrassment by phone from the halifax in the past, but not now {all documented ie: dates times conversations and logged complaint with police and letters to halifax }ect lve kept all this info and wondered if l can take this further in the future as they have contributed in my mind to the mess im in now both financially and mentally any comments if this is poss

It is always good to keep a log of these activities, however it might be hard to prove that it was a direct cause of any health problems unless it was documented. It may be you could get a small amount of compo via the FOS for non financial loss but you would need to prove your case and back it up with factual documentation.

as l said before , had letter fron halifux on the 9th feb 09 stating ppi of £3099.72 has been taken off loan and confirming amount o/s is now £9425.71

admitting that it should have been taken off b/4 the a/c was sold on, offering

no mention of the debt sold back to CABGROT with the reduction , but more worringly have heard NOTHING FROM CABGROT???:tinysmile_hmm_t2::tinysmile_hmm_t2:

my worries are :
ive not signed a new cca for the reduced amount , just had the above letter confirming this from the halifux customer service dept

halifaux has not confirmed that it has sold it back to cabgrot

my payment via cccs to cabgrot is still being sent to cabgrot

when l ask for original copy of cca from cabgrot [ if they have it ]the amount is
going to show the original debt amount b/4 the ppi + payments have been taken off

does this mean they cannot enforce this debt if its for the original 12k+
and as ive not signed anything for the reduced amouint then they cannot provide the copy of the true debt owed ??

still not had any return call from the fos for them to re- open this mess been 3 wks now , l know their busy with more urgent things but...........



bottom line is now ive had to go on benefits cos my sick pay has finished they are all going to get p****d with probally a £ per mth offer
then the phone calls will start ....OMG .. back to square one

another thing which has been gnawing away at me is that the letter l "recieved from the halifax " advising that cabot will b taking my debt over looks very diffent to any other letter lve had from the halifax

the HALIFAX logo is in black+ and much bigger than any other letter ive had [believe me ive over 50+ ] looks a bit fuzzy there is no address under the logo no date ,tel number , no hours of work displayed when you can call them which is on ALL the letters + much thicker paper..... me thinks mybe cabot sent this ??
