    My daughter has run up about 7 grand of debt from my address. She no longer lives here.
    Mercer, the debt collectors on behalf of Barclay Card, have spoken to her to say they will come to my house with a warrant to take things. She has told them she has not lived here for over a month, but they don't believe her!
    Where do I stand with this?
    What do I do about the credit rating for my address? We were hoping to change our mortgage, will this be affected?

    She is planning on going bankrupt, but apparently it costs about £400, so can't afford to!

    Sal as far as your credit rating is concerned, you can 'diassociate' yourself from people at your address (as long as you have no joint liability for debts).

    Have you taken her name off the electroal roll at your address, if not, I would do so immediately.

    Then complain to the OFT/Trading Standards about Mercer, they have no right whatever to come to your home, let alone take anything from it. Even if she did still live there, they would need a court order to do so (I think).

      You should send the CCA letter to Mercers. They threaten all the time, so find out if they actually own the debt first.

      Does she have charges on this Barclaycard? If she does, they cannot pass it over to a DCA.

      Is there a financial link between you and your daughter? Have you ever had things in joint names for instance? If the answer is no, there is nothing they can do to you and your house and Jan is correct, you should disassociate yourself from her with the credit reference agencies. It's not the property that has a credit rating, it's the people living at the address.

        Thanks for that. OH is getting a bit tetchy!!

        Re: the above. She does have non payment, late payment and overdrawn charges, but it's Mercer not Barclay card that phone her all the time and write.
        I don't really understand the not being able to pass it over.

        I also don't understand how she has got herself in such a mess financially! I've never had credit, so didn't learn it from me!

          Sally, I sympathise with you , our daughter is going the same way, but she still lives at home. She wont listen to us. We are living in an I want it NOW society, and if the banks will lend it to me I'll take it no matter if I can pay it back or not. I am techy too.

            I don't really understand the not being able to pass it over.
            A DCA cannot act on an account that is in dispute, once you send a prelim to the bank, you put the account in dispute and the DCA must refer it back to the bank until the dispute is settled.

            It will at least keep the wolves from the door (metaphorically speaking ) for a while and the refund of charges will go some way to paying back the debt.

            Plenty of help here for you (and her) Sal, you only have to yell.

              Sometimes all I can see is problem and not realise what is happening is wrong.
              Having to draw things out of her.

                Sally, Mercers are complete gits, send the CCA to them ASAP and then get reclaiming those charges.
