    Hey,

    New here - please don't bite

    I had a letter drop through the post this morning from Lowell stating that they had purchased a debt from Three in my name and that I should make payments to them. I had a contract with Three, switched to Giffgaff PAYG which was dire so switched back to Three on PAYG all with the same number.

    I phoned Three and told them I want to raise a SAR and that they need to prove there was a valid contract to be able to make a claim against. The Indian woman didn't a clue what I was talking about and tries to palm me off to Lowell. She also told me that because I'm a PAYG customer, I'm not allowed to raise a SAR. No dice love, I'm not talking to those plebs EVER. She transferred me to a very nice Scottish girl in complaints who told me the contract was taken out over the phone via A1Comms, so I'd need to speak to them to get a copy or recording of the contract.

    I politely told her it's not me that needs it, it's them. If it went to court, they'd need to prove that the contract existed in the first place. She said I could make a SAR but categorically stated that Three DO NOT have a copy of any contract with me.

    Firstly, have I done the right thing in asking for a SAR? i know phone contracts aren't covered under the CCA but surely they're going to have to show they have a right to chase me for this supposed debt? She also very kindly told me that Lowell definitely won't have it

    Any advice would be great!
