  • Lowell Solicitors - proof of debt?

    Hi everyone,

Like many others I have been contacted by Lowell financial regarding a supposed debt from 2014. The debt is for a supposedly outstanding payment on an EDF energy account, however, as far as I was aware, the account was payed off. I sent Lowell a letter stating I had no knowledge of the debt and happily carried on with my life. Fast forward several months and they have now passed the account to Lowell solicitors who have sent me a letter of claim, which states I have 30 days to respond before legal action.

Although I feel this debt is incorrect (and have informed Lowell of this in writing) it seems Lowell will issue a CCC unless I pay up. Is there any way to effectively dispute this or prevent the issue of a CCC? In response to my letter informing Lowell I had no knowledge of the debt, they have sent me a pdf copy of an old electricity bill from the period showing the amount outstanding. Does this really constitute proof of the debt?! Is the burden of proof now on me to prove that I have indeed paid it?

Thanks in advance to anyone who can help.

SAR to EDF will really help find out what this alleged debt has arisen from. https://legalbeagles.info/library/gu...ccess-request/

Is the bill that Lowell have provided for dates you were a customer of EDF ? Early termination? Was there any dispute when you were with EDF or when changing suppliers ?

Can you see payments made to EDF in your bank statements ? Any that correspond to the invoice ?

You should complete the reply form stating it is in dispute and ask for any further documents you think are needed to check if the debt is legitimate. Also ask for evidence of assignment from EDF to Lowell.
