Hi
I have a debt with Arrow Global Guernsey LTD which is being handled by Restons Solicitors who back in 2016 sent this to CCJ. So I recognise the debt and I've been paying the debt back as outline by the court which is £5 per month. The debt was for £1459.
I decided I need to clear this debt and get the CCJ marked as satisfied as I plan to get a mortgage in the future and this will hold me back. So I offered Restons £500 to clear the debt even though I still have approximately £1309 to pay. I started low of course but they replied and said they are not in agreement for £500 but said I can clear the debt by paying £828. I can pay this however I needed assurances that I won't be chased by anyone for the remaining debt so I sent the following letter to them.
Dear sir/ madam
Thank you for your counter offer of £828 in settlement of this debt. I am able to make this payment but as a full and final settlement of the account. I am making this offer on the clear understanding that, if you accept it, neither you, your client nor any associate company will take any other action to collect or enforce this debt in any way and that I will be released from any liability.
If you accept this offer, please confirm that you will mark my credit reference agency file to show that the above has been paid and closed. And you will also send a Certificate of Satisfaction so I may forward to the Court House to update the CCJ currently on my credit file.
I can pay the amount I have offered within receiving your written agreement of this offer.
I look forward to hearing from you.
This is the reply I got:
The question is should I take this deal?
They have not confirmed that they will NOT chase for the remaining debt in the future. They mention marking my credit file as partial settlement however after checking my Credit Report I can see the CCJ but not the defaulting credit card amount so will they just mark the CCJ as satisfied but ignore marking the account as partial settlement since it doesn't exist.
I would appreciate any advice given
Thanks
