    Hi all im new to this and have a good old bank issue involving everybodies favourite solicitor Bryan carter aka pheonix recovery aka fredrickson international and what every othere aliases they might go by!
    So im looking for some of your words of wisdom if i may.
    It all started about 7yrs ago my ex and i finished and went our seperate ways. But me being blind to love i guess 18months before that i got a £5500 loan out and also max`t my c card for £2200when we moved into our new home.
    So hence after we seperated i got left with the debt and on my own could not afford it. stupidly i choose to ignore it thinking it might go away. WRONG as i know now but HSBC passed the debt to pheonix recovery who passed a ccj against me in court for the c card but nothing regarding the loan then in 2003 i received my first contact from carters and co threatening me with court if i didnt pay up so i started marking payments of £50 a month for about 6months but i struggled endlessly each month doing so.
    I eventually cancelled the D/D i had with them due to losing my job but still they persisted letter after letter i even tried offering token payments which they refused saying it was enough and i must pay more, so me by now starting to did my heels in told them basically to stuff there payments where the sun don`t shine maybe not the best course of action but i reach the end of my teather with them and there hard ball tactics!
    I know i should be responsible for my debts and appreciate that fact but at the time no money no job i had to look at my priorities and as loans have insurance against default payers as i was at the time i looked at it as a wayout.
    But recently carters have been in contact again saying they wanted payment for the loan so on so on.
    I have only just got myself back on track financially after a long uphill struggle so i offered them £25 a month and said i would review it in 2009 and see if payments could be upped some what then but they refused this payment and harrassed me constantly on the phone. so again i lost my rag with them and told them stop threatening my if they were going to do something then just do it.
    So they did i received a court claim from northamtonshire county court but not for the 5grand but for just under £400 which i dont understand to be honest its to do with charges they say i have incurred with them over the debt.
    This has incurred another ccj now 2days ago i paid £77.25 to them as a bailiff from the court knocked my door and have now arranged a £50 a month payment to them begrudgingly but want to seek advise due to the age of the whole debt and whether or not they can still pursue it realisticly after 7yrs or more
    PLEASE BEAGLES HELP ME OUT IM GOING MAD HERE!!!!!!!!!!!

    As they have a judgement against the normal 6 year limitation does NOT apply.
    Also from what you have been saying it is highly unlikely it applies anyway.
    The clock starts from your LAST acknowledgement, in writing or by payment, and by your own admission you have been making some payments within this time.

    It sounds that this CCJ from Mr C is fresh, in which case something may be done.

    Could you please let us have all of the details of the claim, dates, POC etc and we'll have a look see.
