  • Court papers served - Help!

    Long Story short Been toing & frowing with MBNA and their various DCA's since 2009 with a DN received september 2009 LINK and then not much till January 2012 when Westcott saying they had been assigned the debt (£11K). I wrote back saying the alleged debt was in dispute with MBNA and they wrote back saying they had handed it back to MBNA.

    Today I received Northampton county court papers from Arrow Global. LINK This is the first correspondence Ive had with Arrow Global on it.

    Furthermore the address on the court papers is not mine - its actually addressed to me but at an old peoples home on our street, including their post code and building name. The letter had been opened and taped back down and hand delivered to me by the person whose address was on the papers! I dont know how long he had had the letter but the date is 19th Sept 2012.

    History... I took the card out in 2002 and CCA'd MBNA after ceasing payment in 2009. They then sent me TWO CCA's - both signed by me a month apart. I cant remember signing two! I was told that the agreement was not enforceable by someone who has looked at it back in 2009.

    I want to defend my case but dont know where to start. Ive read somewhere that I should send Arrow Global a cpr 31.14 asking for a copy of my agreement but Im confused as ive also been told to only ask for what is on the claim. I dont know if I should ask for the default notice too and whether to ask for time to allow them to respond.

    I have logged on to the court website but not filed any acknowledgement yet as i dont know whether to file a defence now or an embarrassed thingy to ask for more time to get the credit card agreement from Arrow Global.

    Any advice would be gratefully appreciated
