But of course the points made affect the OP's friends financial position greatly!
As for the MBNA debt that was sold to Arrow Global/Wescot.
Without an enforceable credit agreement plus the correct set of T&C's, their boat is sunk.
Of course, MBNA/Arrow may well unearth the docs in due course, only time will tell.
