    Surprise, surprise...... a letter landed on our doorstep this morning from Amex.

    It appears that they have done an internal audit on the account and guess what they have found that they overcharged my o/h to the tune of some £280 and they have now refunded it.

    He did not even write to them .... but something here smells because no bank or credit card company would refund without being asked so what are they hiding....what is behind this sudden desire to refund money.

    I think some further investigation might be in order here and maybe they have to return compounded interest as well, not just the charges.

        Good thinking CC, I will check that out but not sure there was any PPI. This card from his memory was signed up for at Corely service station on the Motorway many moons ago. It was just just a short application form. We both as rule never take PPI as being self employed most policies are geared to employed persons.

        But it is intriging why out of the blue they suddenly give a refund without being asked for one. Will be interesting if anyone else has the same.They have given some information about the refund it is because they did not send out a letter when two payments was missed. The payments that that were missed collecting was there fault they had a new mandate as o/h had changed banks which they did not collect on from memory and the next thing they put this in the hands of their debt collectors and then you can not get through to Amex for all the tea in china and as we all know the debt collectors are only interested in the debt being collected and not that it was Amex's own fault. This has now been going on for years being passed from one debt collector to another and yes they have broken every rule in the book with their threats and phonecalls. Then suddenly this gets passed back to Amex and at the same time he requested a copy of the original application form. Now I believe that they do not want us to have that or that they do not have it and thats maybe why a refund came his way.

        Definately will be looking into this one further because some recent court cases they did charge compounded interest when they should not have done. I will get o/h to write a letter and ask for the calculations of this refund on how interest was added to the card in conjuction with the charges. Once we get their answer they can apply that to the card from the onset and hopefully this will wipe off the debt in full.

          Would it be and idea to do a Full DSAR for the account also, and list EVERYthing, phone calls, memos etc. that you want

          Wether they comply with it will be a different story I know,
          but,
          the results could be interesting if they do actually comply

          Nothing ventured nothing gained I suppose lol

          If nothing else you could get a laugh at the dismal response you get back from them lol

              With an SAR, the data holder has no choice but to comply. Non-compliance is not an option. If they withhold anything that could be used against them in a court of law, they breach not only the DPA, but CPRs, also.
