  • Capital One vs what

    I sent off request to Capaital one for CC charges reclaim using std template (suitably modified) letter.

    They have sent attached reply.

    Can anyone help with a reply please. :beagle:

    How much are you trying to reclaim? do a spreadsheet using full % cost to you, forget FSA they will only agree with backdate to 6 years, so as many before you have done do the spreadsheet and give them 14 days to respond of which if not replied to satisfaction start county court proceedings against them adding all cost to bill also 8% on top allowed by a court, others I am sure will also advise on the subject. claim all years of charges.

      Thanks Mike,

      The reclaim on this one is around £200, but i have another 8 cards at the same reclaim stage so expect to get similiar rejections.
      Is there a format letter on here i can use in response ?

        Go to the top of page enter GUIDES, 2nd paragraph claims against Credit cards & Banks, template letters there, also on the lower part spreadsheets to use, good luck.

          What, have a look at my Crap One threads, there's a couple of them in the Crap One forum. They tried exactly the same with me but I got all the charges back, not just the excess. There's probably some letters on there you can use. I seem to remember quoting OFT guidelines para 1.1 to them, I'll have a mooch and see if I can find a link

            Hi Whatnest,

            You have already had some good replies from Wendy and Mike and I can only re-enforce what they have already posted.

            Capital One haven't really changed their strategy for handling Charge reclaims demands for the last few years and what they have sent you is pretty much a standard response.

            Have a good read through the Capital One forums and you will find many fine examples of strategies to follow.
            That strategy should include many examples of a letter to send in response ( an LBA ).
            The LBA should include responses against the arguments they have raised including the supposed £12 level, the interest and the Limitation Act.
            You will find many examples of the response to use within other LBA letters.

            You might also like to have a read of my own strategy for reclaiming charges from Capital One. Budgie's strategy for reclaiming credit card charges - Legal Beagles Consumer Forum

            Capital One will not increase their settlement offer until you file a claim with the County Court. To get to that stage you first need to issue them with an LBA.

            Have a go at producing your own ( suitably modified ) version of an LBA.
            It's fine to copy and paste bits from example LBA's that you will find on this site.
            But it's important, at this stage that you also try understand what you are writing and the process behind reclaiming.
            Feel free to post it up on here it you would like it checked before sending.

              I've had a mooch, have a look at my MBNA thread OH v MBNA (Partial refund in 23 days) now FULL REFUND ! - Legal Beagles Consumer Forum Post #2 has a letter containing the relevant bits about OFT guidelines, you should be able to adapt it for Crap One. You'll more than likely have to file at Court, as Budgie says, but they usually pay up fairly quickly.

                  Success at last, refund of all charges with interest.
                  Nearly £200, not bad considering the debt was sold to DCA 3 years ago.
