    Hi All,

    Since being on this site I have really learn't alot of what is possible, though still not very good with the rules and legislation. I have now looked into all of my fianancial affairs.

    I summarise as follows:

    RBS
    Overdraft - currently within limits and agreement

    1 old loan with non optional PPI expired 2007, replaced with new consolidation loan again with non optional PPI. Paid up to date

    1 old letter to RBS in 2007 trying to reclaim charges, but they replied with reference to the court ruling

    1 RBS Credit Card - unenforcable CCA - I have put the account in default at the moment. PPI on this but I cancelled in 2007 because it was too expensive, but I wasn't aware of my rights at the time - now I am! Many charges on this account, which I presume could be reclaimed. - WendyB and KYrights have kindly given some guidance on this.

    MBNA
    1 Credit Card. PPI on this. Apparently CCA does not conform with Consumer Credit Act. Replied asking them for the correct details. Hope to reclaim PPI. Do I also need to SAR these?

    Abbey Mortgage - have arrears but have been under arrangement with them. Pay so much and they will add the remainder to the balance - which we genuinely thought was good of them. We have overpaid a couple of times to try and bring it down and last month we paid 3 days early!!!.

    However 2 or 3 weeks ago they sent us a repossession notice. We rang them and they said I had to wait the ten days on the letter ( from a solicitor) We then rang them again and they apologised and said it shouldn't have gone to the solicitor and they would arrange for the file to be returned to them and if we recieved a solicitors letter we were to call them. We got the solicitors letter so I called the solicitor to advise them that the account had been sent to them in error and suggested that they contacted their client. The solicitor asked me to hold because they have online access to Abbeys notes. She confirmed that she had seen the notes on file and that she would contact her client. Then we got another letter from Abbey saying that they were applying for repossession. So we rang them again and this particular credit controller stated that the file was still with the solicitor. We have been under agreement since the end of January and have complied with all their requests for payment etc - (I paid them over £1600.00 last week for a months payment on a 100k repayment mortgage). The last letter we recieved was last Friday, from an Abbey Office in Milton Keynes with another notice of repossession. We have asked them for proof that there is no impending action and asked for the reason why we have had all this hassle when we are under agreement with them and an apology. Whether we get that remains to be seen. Is there any recourse on this?

    RE RBS - WendyB has advised me to SAR RBS. Will I get all details for all loans, bank accounts and credit card from the same SAR or are they seperate?

    There is a lot of admin work and letters to write so I am setting my stall set out to tackle them all. There seems to be a considerable amount of money kicking about overall which I may be able to reclaim and reduce my debts with it.

    I am a company director (my own company) I didn't realise this classed me as self employed. I have now found out they only pay out if I go bankrupt? What a waste of money. There are 2 lump sum PPI issues on the loans and 2 variable on the 2 credit cards.


    Added: Does the SAR include my wifes name. Loans and bank account are joint, CC in my name only?

      Hi Redspike,

      With regards to your SAR query (I'm just going through mine from RBS at the moment). They'll send you information on any account details mentioned, so I would list all your loan accounts, current account and credit card numbers. That's what I did and I was suprised at just how much stuff they keep on a customer.
