    I sent MBNA a CCA request for an A&L branded card which had an initial 0% APR for balance transfers on 11/11/09 via recorded delivery and got a reply from them on 5/12/09 which was 18 business days later.

    To date I havenot stated to them that I consider the account to be in dispute and last payment was made on 30/11/09 as I didn't want to stop paying before I knew where I stand legally.

    I have blanked out my name etc. Otherwise these are exactly what I received with no page numbers. All photocopies on A4 paper.

    MBNA 03 has my name and address printed above barcode area and my signature in sig box. it is as illegible as it looks on photobucket.
    MBNA 04 printed on back of MBNA 03 page
    MBNA 05 has printed name & address - no sig or date
    MBNA 06 is 1st of 4 pages of terms - has my name & address printed below lender details

    Would be grateful if someone more knowledgeable than me can give an opinion on whether it is

    1) an acceptable CCA request response
    2) It appears to be a properly executed and enforceable CCA
    3) My options for further action or what I can do next

    For what reason did you request CCA? Are you in difficulty paying them, are there arrears on the account, are any DCAs involved?

      I requested the CCA because I am struggling to make the payments. There are no arrears yet but I have had late payments virtually every month this year.

      My financial circumstances have changed and I have a lot less money each month. I Have been in contact with CCCS and will be sending all of my creditors a token payment letter. Basically, I am now trying to deal with my creditors. I have two Barclaycard CC and have made similar requests as a first stage of the process of dealing with my debt / creditors.

      The card originally had a 0% rate for balance transfers and I transferred + £4000 when opening it. They then increased my credit limit during a low purchase APR period and since it finished the rate has been increased to 27.9%. I recently applied for a 0% APR balance transfer CC and was refused - probably because of recent notes placed on Credit file due to the late payments.

      I simply want MBNA to prove that they have a properly executed agreement and I also want to claim back all penalty charges.

      I sent a SAR request on 1/12/09.

      Any advice would be greatly appreciated.

        MBNA were a breeze to get the charges back from have a look here at the surprisingly easy time I had with my OH's MBNA card.

        Barclaycard are pretty easy too, have a look in the Barclaycard thread and take the 9 day challenge lol.

        It is better to make payment arrangements if you can then this stops the debts getting passed on to DCA's, and you will be in control.

            i persoanlly think it's always better to keep paying them if you can. If you then decide to go down the unenforceable CCA route that's a different story. I'll bump this up to get more opinions.
