    Thanks Budgie! Will follow your instructions and see how things go from there. The 20.57% was taken from their generic T & C's, however I will use your rate instead.I have not sent them a copy of the spreadsheet as yet so will do with the letter.

      No problem Ruby,

      Do not race ahead and send off the letter.

      Post it up here first so we can fine tune it.

      If we carefully word the letter we may be able to get this matter resolved without the need for Court or FOS action.

            Just a quick up date. Got an offer of circa £550 which I accepted on the provision that it is the full and final settlement against the account. The total owed is just under£800. I am awaiting a reponse to that.

            I am going through the same process with hubby's Crap One card. Sorry to be going round in circles but please could someone confirm whether the CCA agreement has to be signed in order for it to be enforceable. Hubby's card dates back to be beginning of 2008, so its a bit more tricky.

              Further update ....

              Cap One are defending that their application form is an enforceable agreement. (surprise, surprise!) I have refuted that by saying to them that the original T & C's are not embodied within the document and other prescribed terms are missing.

              I have again pointed out to them that the £500 is f & f settlement and I signed the settlement form as such. I Hand wrote the full and final bit on the settlement form and the refund has gone through.

              The outstanding balance is only another £200 +/- but they are not getting another penny out of me!
