    Hi Swepstone,

    Town's free legal clinic to open


    A free law clinic for Reading residents is set to get under way.
    The town's new monthly legal surgery will open at the CommuniCare advice centre on Kings Road at Cemetery Junction from 3 December.
    Funding for the scheme was raised by the University of Reading's Law School staff, who took part in the 2009 London Legal sponsored walk.
    The clinic will provide advice in areas such as consumer, debt, employment and landlord and tenant law.
    Helping the community
    The service is a joint initiative between the university's law school, legal firm Shoosmiths, CommuniCare and LawWorks - a charity which supports the delivery of voluntary legal services by lawyers.
    Staff from Shoosmiths, who will provide pro-bono [free] legal advice, will be supported by law students from the university.
    Professor Patricia Leopold, from the University of Reading, said: "The school of law is keen to encourage students to use the skills they acquire as law students to assist in the community.
    "Working on this project will provide an additional opportunity for students to use these skills and to develop new clinical skills."
    Richard Harrison, of LawWorks, said: "The clinic will help people identify their legal problem and provide some initial legal advice and guidance on appropriate next steps."

      Thanks
      For that i still feel a bit gutted and not sure what I should do. Also it is my understanding that you can apply for a stay at any time and they then have to go through the case all over again.

        As discussed do a write up and let everyone know what happened at court at the moment people and give a time line start to finish of what has happened overall.

          Hi Peter

          Mochamoo has filled me in on what happened, it does sound like you werent given much of a chance to put your side across however the judge did have the witness statement and the original letter you wrote which laid out your arguments - had you appeared in court the first time things might be different, but as she decided this was the most important thing you were knackered from the start.

          Did she give you an installment order alongside the Charging Order ? If not then you should arrange this directly with Lloyds.

          I still think the set aside was the right angle to take rather than appealing, tho I can see her point of view as it would have been a considered judgment (in essence) rather than judgment in default.

          If you wanted to carry on with it, ie appeal the judgment, then because your case is based on the CCA I really do think you will need a solicitor who specialises in the consumer credit act - however I sure you realise that you risk costs with any further defence against this claim. There are a few specialising solicitors out there who are good, and who don't take up front fees.

          If it were me, as you don't actually dispute you owe the debt and wish to rely entirely on the basis of lack of prescribed terms in the application (agreement), then I'd be making the installment offer to slowly reduce the amount of the charge on the house.

          Did the judge allow lloyds to continue adding interest ?

          I'm so sorry this hasnt gone the way you hoped.
