  • Ombudsman

Hi all, I need advice on the next course of action to follow up.
Sent MBNA 7th March 09 letter requesting copy CCA. Received no reply within the 12 days. Then wrote them letter 26th March reminding them of thier obligation and that after 8 weeks i will inform the Ombudsman.
To date no reply from them.
    What should i do next?

    Re: Ombudsman

Why have you sent for a CCA?

What is your situation with MNBA

Can you give us some more information then we can point you in the right direction

      Re: Ombudsman

I owe them about 4k on the card to which they set a default on my credit file - There are however about 1.8k of disputed charges - they made an offer of 1.5k to which i have not replied.

So are you claiming your charges back then?

        What stage are you at?

          Re: Ombudsman

I have not yet made a claim for the charges. I am awaiting on receipt of my signed agreement - to see if this materialises. My MBNA account goes back to about 1995.

            Re: Ombudsman

If you have not been claiming charges, then how has their offer come about?
You say there are disputed charges on the account, how have you disputed this?

Can you give us the full story, so we can see the big picture
What you have sent to them
Is a DCA chasing you for money
            Are you making payments?

The more info, the better we can help you

              Re: Ombudsman

I owe MBNA about 4k. I could no afford to pay them as i lost my job last Nov. They then issued a formal demand and went onto register a default on my credit file. This March they sent me a letter offer to accept £1.5k to settle the matter. I then sent them a letter on 7th March asking to see a copy of my consumer credit agreement (no reply receeived). I also sent them another letter requesting info on unauthorised charges (to which they sent me a full statement).
The situation now is i have heard no more from them and there is no DCA involved and i have not paid anything . I hope this makes it a litle clearer.

                  Re: Ombudsman

I would claim the charges back and also putting the debt into dispute
