  • BarclayCard unfair charges repayment

    Hi everyone. :tinysmile_kiss_t4:

The love of my life and myself are currently going over a claim she started in 2007. I issued a reminder LBA in March of this year and today received more statements albeit FROM March 2003 onwards (whereas the original request in March 2007 was for statements from March 2002).

It was noted that up until today, she only had statements till Feb 2007 whereas statements received today included March and April 2007. This has rubber stamped Barclays intention to refund as the staements show that £336 had been refunded into the account. The account was suspended by Barclays as the April 2007 statement is the last. The funny thing is, the account has been £336 IN CREDIT since that date. The account had been at ZERO balance between June 2006 and April 2007 (when they decided to deposit £336 without her knowing and has not been officially accepted as settlement of any kind as she was unaware until today that the money was there)

Anyway, the original claim was for £840 in charges only, so from what they had paid into an account that she doesn't have access to and the original claim it seems they have paid the difference (£8)...... clear as mud hey

Soooooo I have now re-looked at the charges and included the compound interest for these charges and the total is now £1665.86. Double what she had originally requested back.
Now because they have already paid an amount of these charges, it's just a case of telling them to re-check the figure, include the interest and ask them to pay....again.... Simple, Right????????????

Has anything changed on the claiming front?

But then I also notice that she has paid PPI on this card which back in 2002 when the account was opened and as we know it's automatically added to the account.
This insurance was never requested, although she did try to make a claim on it many years ago and was refused and payments.... So there is a total, including the interest of £1906.16 to claim.
We do not have a copy of the original agreement to show the PPI was requested or to show the PPI was a separate option. So maybe a request should be sent or just a request for the total amount plus interest and see what there response is????

Any changes on the PPI claiming????

Love you all still, even if I ain't been around.

Hi Phoenix, nice to hear from you again.

This insurance was never requested, although she did try to make a claim on it many years ago and was refused.

Why was the claim refused do you know?

Hi Enaid... hope you are well

I'm afraid I have no idea at the moment. I will find out later though, she is at work till 9pm. She only mentioned this morning that she tried to claim on it but I dont know any details. It may have been an inquiry into a claim, it may have been an actual claim i don't know but I will get more details later.
I guess this may have a bearing on whether she could claim it back or not hey?? :tinysmile_hmm_t2:

Well unless it's a valid reason not to pay out I think it could have been mis sold.

it was an inquiry about making a claim. the verbal information over the phone was that she could not claim. It was for unemployment due to health reasons...sooooo not an official claim :tinysmile_aha_t:
