  • CCA Agreement

    I have received my cca agreement from HSBC they have sent me 6 sheets of papers with the terms & conditions e.t.c but what I would like to know is does the your signature have to be in the four corners of the agreement. I have posted the sheet that contains my signature and could someone tell me if this seems fine please?

    My OH has an arrangement to pay off his credit card debt with HSBC at 5.00 a month and he has checked his credit file and they have entered a default against his name. Are HSBC allowed to do this?
    He received his cca agreement after sending a cca request and it was enforceable because it had his signature. He has not received his S.A.R since requesting it in Dec 08. The Information Commissioners Office have written to HSBC asking them to comply with his request.
    HSBC raised other half's credit limit also without him knowing to £3,100.00. Are they allowed to put a default on his credit file even if they don't comply with his S.A.R?
    He really wanted to get hold of this because he knows that there are a lot of charges and interest that have been applied.

    Any suggestions from anyone on what to do next please?

      If that's all they sent then it's total cobblers, but I'd have to see the ENTIRE agreement before I could say. After all it does mention page 6 of 7 on the bottom.

      As for the OH's "agreement" can you post that as well.
      A document simply signed isn't necessarily a compliant agreement.

        Thanks curlyben, the other documents have all the rest of the terms and conditions so I guess it is enforceable. The thing I was wondering was that they put my OH's credit limit up to £3,100.00 from £2,500.00 and he did not ask for this nor did he give his written consent. Now even though he has set up a payment plan with them he has not received his SAR to see much interest and charges they have applied.
        HSBC have charged extortionate fees and we are not disputing paying the debt owed but find it unfair to pay so much extra.
        We would like to clear this debt as soon as possible but will take forever if they don't take these charges off if you get what I mean

          That being the case I'd recommend approaching Payplan as they hold some clout with these people when it comes to high interest rates etc..
