  • When does a Credit Card debt become statute barred?

Hi hoping some of you could help me understand when exactly an old credit card debt becomes statute barred.

I have an old Credit card debt that's been passed onto several debt collection agencies. I made my last payment in August 2017, haven't communicated with the original Credit card company or any of the collection agencies since then. The account went into default in March 2018.

Does this become statue barred 6 years after the last payment/acknowledgement or 6 years after the default?

    Any help is greatly appreciated.

      Atticus is correct.

What I would add is their Terms & Conditions will state what they will do if the account holders fails to make payments, accounts are normally Defaulted after 3 missed payments.

NB any payment/acknowledgement after the default notice, but within 6 years after, sets the 6 years clock back to the beginning again.

I have another question I'm hoping you guys might be able to help me with. I seen a debt advisor today and I may be eligible to apply for a debt relief order.

I asked the advisor this and they either didn't understand the question or didn't know as she just sort of talked around it.

If I was issued with a DRO that began before the debt became statute barred but ended early after the debt was due to become statute barred. Would that affect the debt becoming statute barred?

Or does actually the including a debt in a DRO effectively count as me acknowledging it?
