Barclaycard Online Applications

I have requested the CCA under the CCA1974 and SAR from Barclaycard. They have replied now after long time in ignoring me that they don't have a Application form as I applied online.

I think they are indicating that they don't have to comply because I applied online. Is this true?

I would appreciate your replies and any comments to add to my response letter to them.

It's partly true.
They should have documentary evidence that you did indeed apply online and as such they should supply that.
Now there are slightly different rules for online applications covered under and SI from 2004 concerning electronic signatures.

Ok, So how do I find out about what the agreement contained, because the T and C's has no reference to interest rates etc?

Because I am getting hassled from Mercers, If they do eventually go to court, surely they must have to provide something to rely on in court ? wouldn't they? I can't pay them I am fighting to try and stop my house from being repossessed.
