    Evening all. Put my first 2 posts on this evening after reading the threads with interest. Hello everyone.

    I have sent off a CCA request to B/card giving 12 working days. Responded within the period & sent me a completely blank form. Not signed/dated or with any details on it. They obviously do not have my original application or any other form of agreement document. I then sent a 2nd letter giving 8 weeks to respond to the dispute/complaint & 21 days to respond to the demand to rmove my details from the CRO's. This runs out next week & I have not had a response.

    They are still charging interest, my statement shows me as being in arrears & they have texted me to advise me I might harm my credit rating.

    While I am faily certain they are not going to be able to provide a valid document & I just need to hold my nerve, what can I expect next? Any suggestions as what to do once the 8 weeks have passed by?

    I have another post started under 'MBNA Strategy; with slightly different results to this. Probably going to be a bit more complicated.

    Any advice you can offer will be welcome.

    Any charges you might be able to reclaim that would offset what you supposdly owe? You might need to SAR them to be able to work that out, assuming you don't still have all your statements.

    Have you defaulted on this account, or are you just contemplating not paying them? I ask, as obviously just looking for a way out of paying on a technicality is not what this site is about.

      Thanks for reply. No I have not defaulted & I'm x1 payment adrift. But I have just been made redundant. There will be payment issues coming up. Their contact centre attitude when I rang them recently was appalling & a relative in financial difficulty is going down the same route. So far they have just sent me a couple of texts & stopped my account.

        Well, you need to contact them to set up a payment plan, if you intend to settle the debt, even if it takes a long time. Just becuase yo u know there will be payment issues is no excuse to sidestep the debt completly by using CCA. In my opinion.

          Whilst I agree with Wendy, in the event that they become difficult and refuse to help you through your difficulties, it is always worthwhile going the CCA route.

          The reason I say this is because IF there are issues with the agreement, then you are in a strong bargaining position, and will probably find you get a lot more cooperation from them if they think that there is a possibilty of you stopping payments altogether with little chance of enforcement.

          I hope your emplyment problems are short lived. I wish I had been armed with the knowledge I have now, 16 years ago. I wouldn't still be trying to get on an even keel even after all this time. Remember, knowledge is power.
