  • Duplicate Default on Credit File

    Hi

    I have just today checked my credit file with Experian and found a duplicate entry from Motormile Finance for a Default for an alleged Payday Loan of £637, this entry has only recently been placed. The dispute has been going on for some time (3 years approx). However today I picked up that they have made a second credit file entry for the same default, same amount, same account start date, only thing different is the default date (3 months difference), one states 17/09/2010 and the other 07/01/2011.

    MMF still havent proved to me the debt actually exists or who the original creditor was despite numerous letters requesting this information.

    Some advice please?

    Note - I'm not a lawyer or an expert. I'm just a guy who has had to deal with some wrongful defaults.

    1) Make an official complaint to them.
    2) Ask for a copy of their complaint procedure.
    3) State that you want a deadlock letter.
    4) Record any conversations, but DONT tell them you are recording (they don't have to legally know and it's amazing what they will say on the phone).
    5) Complain to the CRA's (won't do any good but gets them moving).
    6) Find out who the original debt was with. They have sold your information - if they have done this incorrectly you can sue them.
    7) Complain to whoever sold the debt.
    8) You can complain to the ICO (but when I did they fobbed me off, they want copies of documents I don't have and which I can't get).
    9) Don't be afraid to start a claim in the small claim court - they fear this. They have to spend money sending someone to YOUR home court, and they are scrutinized by someone with legal training. My research says most DCA's don't like a hard fight. They like picking on people who won't defend themselves.
    10) Good luck - it takes a lot of energy, a lot of stress but eventually it will be all sorted.
