  • Have I filled in the wrong court claim form?

    I made a claim against the bank for errors on my credit report and I wanted the problem fixing and compensation. I was asked at the county court if this was a claim for money. I said yes and was given a application for a money claim which had to be sent to Salford. They have not disputed this.

    I now have the main form which I have to full in Section D Judgment details: I fill in the costs here. The problem is as this is a money claim form there is no way of addressing the main problem of my credit report. I want them to remove themselves as well as damages. This form does not allow the second part to be addressed only the money part.

    It is a bit like a builder does a bad job fixing your roof and the rain comes in. Do you want only damages to your furniture or do you want the roof fixed as well.

    My original N1 claim form stated that I wanted them to remove themselves from my credit report as well as damages. The money claim for has no way of stating this. Only to fill in the money claim part of it.

    On the back of the money claim for is section E: Objections to the defendants proposal for payment. They are not objecting to payment. I am ticking box A[] The defendant has not filled an admission or defence.
