  • Please help!!

    Hi,

    I am currently having a problem with a default that was registered against me on 12/10/2010. This debt was the responsibility of my ex partner who was paying the debt back however changed jobs and the payment due to them run late. The debt was totally cleared with them 26 days later on 07/11/2010 yet a default was issued, I never received any notification of this default, I had moved out of the house in the September. The original loan was with a payday lender but was sold to MacKenzie Hall the DCA. The actual amount of the debt consisted largely of fees and interest charges as opposed to the amount actually borrowed. The default was for £1031 but I don't believe that was the amount that was outstanding at the time it was issued. This default is ruining my life and stopping me from achieving my goals, I have written to MacKenzie Hall and asked them to remove the default as it was not actually me that took out the loan it was my ex, but I do not have a crime reference number and it is not a route that I was to take.
    Does anybody have any advice that could help me remove this default.

    Are you saying that the loan was taken out in your name by your ex?
    Were you aware what your ex was doing when they took out the loan?
    Who issued the default ?
    Did you get a notice of assignment from MH?

    If the loan was being repaid on an arrangement then I fear that they were within their rights to issue a default . The default should be showing as satisfied now, is it?
