    Hi, would appreciate advice on what course of action is avail to me following refusal of Fos to remove default they and creditor both admit is flawed in so much as no default notice was ever seved. Can I take this to court, what is likely time scale and costs, can I do it myself

    I'd be very interested to see the FOS report into this.

    At this stage, until I know more, I would not recommend taking to Court with a FOS decision against you.

    Have you tried appealing the FOS decision?

    But more background would help hugely.

      Cel, thanks for your reply. Am awaiting written confirmation of recent phone call with FOS, but essentially they are saying that as there is no evidence that I could have paid arrears, even if I had been correctly served with a default notice, then in fairness the default notice stands..

      Also curious if this is worth fighting in so much as, if successful can creditor then simply issue a new DN or simply sell to DCA.

        God! FOS using template letters? judging by the above, I had that as part of a complaint a couple years ago?

              Any thoughts on the real benefit of having defective/invaliddefault removed via FOS - ie does this just simply put the creditor back in the position of reissuing a valid DN and starting the ball rolling again - am I just opening up a can of worms and inviting trouble - any advice would be appreciated.

                I can't see how the FOS could state that a dodgy default notice is 'acceptable' if they judge you couldn't have afforded to settle it at the time?? There are many options to getting hands on money in desperate times....family, friends, kids piggy banks, ebaying everything you own etc etc.

                  Cel, thanks I agree - but they have scared the hell out of me for now - the thought of failing and having to try a different route is doing my head in - just starting to recover from clinical depression - this is setting me back - paradoxically now worried that if I am successful it simply gives the crediditor another bite of the cherry - issuing a new DN - two years after original defective one and starting the 6 year clock again!

                    Cel, agree with your comments about getting hands on money - have also argued that by not serving a default notice I was not given the chance to remedy a breach!

                      If my credit file is marked as a zero balance in respect of the above DN does that mean their is nothing to be sold onto a DCA.
