Hi guys new to this site but looks really helpful. Here's my problem I have been defaulted on my credit report by llyods tsb therefor can't get any credit. I had an overdraft with them in 2005 but moved house and banks, the overdraft limit was £200 and when I changed banks I was about £80 into he overdraft, stupidly I left this open and its built up through interest and charges over the years. I haven't acknowledged or paid anything to llyods since may 2005. Last year I got letters and phone calls from several different debt collectors and have ignored them all. Anyway lloyds defaulted me in November 2010 more than five years after any contact, this is causing me huge problems as getting turned down for any credit despite being debt free. How do I get lloyds to take this default for £312 off my credit file? Any thoughts or ideas on this much appreciated.

Well they sure won't volunteer to remove it!
Lloyds shouldn't have defaulted you five years after the debt was created. There should have followed a few months of attempts to contact you, then default you. Four months is recognised as the accepted timeframe.
First step is to send Lloyds a Subject Access Request under the Data Protection Act. We have a template somewhere, shout if you need help finding it.
We need to find out what happened between 2005 and 2010.
The debt itself is possibly statute barred under the Limitation Act. ARE YOU SURE YOU WALKED AWAY FROM IT IN 2005, not 2006??
However, registering a default is not deemed 'enforcement', so technically the default itself is correct but it's the timescale that raises the issues here and could open up a pathway to challenging the default."Although scalar fields are Lorentz scalars, they may transform nontrivially under other symmetries, such as flavour or isospin. Thanks Celestine. Yeah I have paperwork proving no payment on account since 17th may 2005. Several debt companies have offered 50% off if I pay the latest being a company called westcott. What does an SAR mean or do? Sorry I have no knowledge on these subjects. I have a good credit record apart from this one thing and its really affecting us.

A subject access request is a letter you send bank to force them to send ALL data they hold on you. You have to pay a £10 fee.

I have all account statements as I made debt company prove debt was mine and they sent me them proving it was indeed stattue barred. Ok will send off SAR letter with £10 postal order and see what they come up with. Do I just send it to my local bank? Once again thanks for the help Celestine

You will need to send the Subject Access Request to Lloyds Data Controller Address which is:
25 GRESHAM STREET
LONDON
EC2V 7HN
SEND RECORDED DELIVERY
Provide the relevant account number/s
They have 40 days to respond.
In the meantime, I suggest a very strongly worded letter demanding an explanation for this behaviour.
Ignore Wescott et al, we don't know yet whether they formally 'own' the debt or not; but irregardless of the default, the debt itself IS statute barred and is unenforceable. So they can basically take a long walk off a short pier.

I've just spent 2 years suing Lloyds for a very similar situation, Judgment is due within hours, so I may be back smiling or weeping! Regardless of the result in that case, you are protected from such behaviour by legislation such as the Data Protection Act s.13.

Yeah some help would be much appreciated Celestine thanks. In terms of money who knows how much this has cost me but I have tried to get several car loans credit card and different mortgage which have all been declined because of this default, also the stress on family life as my wife can't get any credit because we are linked at same address its a nightmare.

e.g. forced you to use sub prime finance, higher interest rates, loss of opportunity etc

Tried tesco finance car loan rejected for default oct 2012.
Argos credit card rejected
Not much else to be honest as I realised there was no point in applying for credit. The impact hasn't been huge so far as my mortgage has moved onto standard variable rate however if interest rates rise I could be in a difficult position and since this default will remain till nearly 2017 it's a worry.

Well I'm not going away I feel I have a good case for wrongful entry on my credit file and this default was 100% placed on my credit file after it became stattue barred so if it takes months and lots of letters then I'm prepared to give it a good go. Hopefully you can point me in the right direction of action to take seeing as you have been dealing with something similar.
