I was wondering if there was anyone on this site who would be able to advise me on the best next steps to try and take on Barclays with what I believe is a wrongly given default.
Earlier this year I received a phone call from Barclays Collections Department but the call was cut off mid conversation. When I called back I explained to the gentleman that I did not believe that I had an account with Barclays so he asked me some personal details to check for the account on your system. He was unable to find any evidence of the account and when I asked why I was in receipt of a phone calls from the collection department he said that he thought that my mobile number had been linked accidently to an account somehow. I asked him if he could search on the system to remove my phone number from the account and he said that that was not a possibility due to the nature of the search system. He explained that he was very sorry for the calls and that I should ignore the calls as it was a system fault and that they should stop eventually. I followed his instructions but became concerned when the calls carried on. I am a teacher and as these calls always came during my working day I was unable to answer them. These missed calls still concerned me even though I had been told that I should ignore them and I began to worry that maybe it was some sort of scam. I decided to contact Barclaycard on their official number as I knew that I definitely had an account with them and was worried that perhaps the calls were regarding this account. I spoke to an agent and explained the situation and my concerns regarding fraud. She then contacted Barclays Collection Department who again confirmed to her that I did not have an account with them and that the calls were a mistake. I have since contacted Barclaycard and they have a log of this conversation.
However, I then went onto to receive a letter from a company Credit Solutions who explained that they were now responsible for collecting this debt on Barclays behalf. Credit Solutions told me that I had to contact Barclays to make these letters stop. I did contact Barclays Collection again and I was told and once again that I had no account. This time I refused to get off the phone until they found this nightmare account and with some assistance from a manager they found the account.
It turns out that whilst at uni in 2005 I had opened a current account with a £250 overdraft which I had used and then never used again. I had genuinely forgotten about the account but obviously would have paid the small amount to have stopped a default being applied to my records.
I wrote to Barclays asking them to send me my original credit agreement and the default notice and explaing this whole ridiculous situation. They responded saying that with the information that I had given them (which wasn't very much) they could not provide me with these documents. It looked like a very generic letter to me. They did not refer to any of the issues stated in my letter about me trying to contact them and instead just focussed on the fact that they couldn't find the requested documents.
What shall I do now? I have not yet admitted to knowing that I did have this accouunt and have not given them my uni address.
