I'm new on here but helping a friend in an IVA with quite a few credit agreements.
One of the agreements with Nationwide was assigned to Moorcroft who confirm they hold legal title. I'm not sure about all dates and things yet and might submit a DSAR but what I do know is that a Default Notice issued by Nationwide in 2007 is faulty on three counts;
1. Debtors name and address is not present 2. Dated 17th October 2007 demands payment on or before 31st October so not 14 days 3. It demands the entire balance not just the arrears
My question is, how does this affect the agreement now after assignment and if it was flagged up to Moorcroft, are they able (entitled) to issue another DN if payments were not met?
I'm thinking in terms of Data Protection where her file has been marked as defaulted all these years where no valid DN was served?
