I signed up to an online SIM only deal with Vodafone via Carphone Warehouse in February. The contract is for 12 months and the tariff is £20 pm reduced from £40pm and with free Spotify. I have all the CPW confirmation e-mails telling me that I signed up to that contract/tariff.
My first months bill was £40 instead of £20 so I phoned Vodafone, who told me that there was nothing they could do as it is a CPW issue. I visited a CPW store, where staff looked at my account and told me not to worry about it as it would be corrected before the money was taken from my bank. When it was taken from my bank, I called CPW who said that they would sort it out.
My second months bill was also £40 instead of £20 so I phoned Vodafone, who told me that there was nothing they could do as it is a CPW issue. I called CPW who said that they would sort it out. I also enquired about the Spotify and was sent a link to sign up.
My third months bill was £50 instead of £20 (£40 account charges and £10 Spotify) so I phoned Vodafone, who told me that there was nothing they could do as it is a CPW issue. I called CPW and told them that if it wasn't sorted I would take them to court. The guy on the phone was very understanding and offered to lodge a complaint. He said that their internal online sales department could only be contacted by e-mail and that this would take 5 working days, but that once he got a reply he would call me back. I never received a call back. Today I have spent 2 hours on the phone to CPW being passed around their South African call centre, being connected to seemingly random people and often just being hung up when I explained the issue.
I've just looked on the CPW website to see how to lodge a complaint and when you select the complaints section under 'contact us', there is no information.
I really can't see that I have any other option but to send a notice before action so they take this seriously, but I'm not sure which laws to mention? I presume that it will be based around breach of contract and also breach of the consumer credit act. Also can Vodafone really accept no liability and pass the blame to CPW? CPW may well be responsible, but my contract is with Vodafone and it is them who are taking the money.
