  • Replies from CCA request - cant supply agreement, what next?

    I have been in a DMP for around 10 years and have recently sent CCA's to all of my creditors.

    I have the following 3 same replies today (Idem, 2 with Moorgate) saying the following:

    Unfortunately we are unable to supply a copy of the credit agreement and acknowledge that until we do so the agreement cannot be enforced. However the balance of the account is still outstanding and we will continue to pursue the debt which will include registering arrears and defaults. We will continue to contact you to discuss your repayment proposals.
    You are free to take whatever action you consider appropriate but we will not be releasing you from your obligation under the agreement.

    Any ideas what to do next? I am still paying into my DMP via Step Change.

    My ideal plan is to clear everything in my DMP if possible in the quickest way possible and get my credit file better in order to get a mortgage in the future. I have some money from family to put towards settlements but IDEM previously refused both offers (£14k o/s, 1st offer £5k, 2nd offer £7.2k).
    Idem are currently the only creditor left in my DMP to be reporting as late payments on my credit file each month hence.

    Are the accounts still showing on your credit file ?

    Sadly as you have been paying them you will need to wait 6 years for them to be SB

    Personally I would stop paying however if you feel you want to settle them you could write saying that

    As you can not supply the requested documentation and as such by your own admission these accounts are unenforceable I will no longer be paying anything towards them.In addition until such documentation can be provided I feel I must deny all liability to you regarding the matter. I am prepared, however, as a gesture of good will and because I have a small sum available for a limited time to offer a settlement figure in full and final settlement on the understanding that the account will be settled and not sold at a later date. the sum I propose is xxxxx (say 5% ).

        Idem are the only creditor still showing on my credit file as late payments each month. If I stopped paying it, what's the worst they can do if the don't have the credit agreement out of interest?
        The other 2 fell off my credit file with defaults some years ago. So I guess if stop paying they can't report anything more?

        I'd rather offer settlements to close the accounts, I used the CCA route for leverage really for getting good settlements as Idem refused my previous two offers which I thought were more than reasonable.
